I know this is a year past your original posting, but wanted to inquire if you ever received the check for your buy out at Bellaire/U Hotel? We bought years ago as well, made an appointment with Carlos last year to discuss a buy back but he never showed up for the appointment. We waited 2 hours. I was pretty convinced when we left that we were again going down the path of no return - money that is. We are leaving for Mexico on Friday for a month and were debating about visiting the complex again, but do not want to get tied up again for time and money.

I know my advice and a dime will buy you a cup of coffee but if your going down to PV it might be OK to check out the Hotel U but I would leave your wallet at home. They will never finish the building and the chances of getting your money back is less than none. I would be curious as to there line of crap but I can assure you, "You will never see this project completed!!!" The principles are pure crooks and thieves and they will lie with a straight face just to steal your money. They have no intention of honoring any agreement they may make. I have yet to find anyone who has received any monies or a contract that can be used in any form or fashion. Please whatever you do, DO NOT GIVE THEM ANYMORE MONEY UNDER ANY CIRCUMSTANCE!!!

I spoke to the other "salesman" Mario or it could be Carlos's other name, three weeks ago and my report is on this site posted earlier. Mario is now selling timeshares at another resort where we are staying and I spoke to him several times only to hear even more lies. The newsletter is out again today with the same song and dance.

We also "own" a "fractional ownership" in the Belaire/hotel U and when were down in PV this past month had tried to get an appointment with someone to discuss a buy back option only to be told at the last minute that "all the salesmen were on holidays" I wonder if I would have got the same reply if I had asked about a purchase

We visited Hotel U in March 2012 and Mario told us they needed $12,000 additional to pay for closing costs on our buy out, This has been going on for one year and their 2nd request for more money. Mario said we had to pay immediately and our money (including closing) would be refunded the following week.We already have $20,000 invested and felt we had no choice but to pay. We called when we got home and were told there was a delay because of "Easter Holidays in Mexico" Told to phone again May 1st. Called again today Mario has skipped) and we were told to call end of May.

On September 21st I went to the site and met with Mario Zargatori, not sure of the spelling of the last name as he didn’t carry business cards. He represented himself as the Hotel attorney and part owner. He stated that my 1 bedroom time share was now worth 6 times what I paid 5 years ago however I would have to convert my time share to Hotel U for an additional fee of 80% of my original cost. Hotel U members would have priority. I declined and he said that he would have to report my denial as choosing to terminate my membership. The restaurant has been closed to the public; there were 2 attendants at the hair salon but no customers. They have removed most of the blue window glass from the 2nd floor. Mario stated that they are going to change the shape of the exterior to a square design and enclose the 2nd floor with solid walls for the casino. There was no construction activity. He stated that the workers and furnishings were coming from Monterey in two weeks. Note their July newsletter said they were coming in one week. I also met with one of the attorneys from the law firm that is processing the class action lawsuit. He has an office in Puerto Vallarta and speaks English. The attorney also mentioned that it is not a Mexican law to pay a 10% upfront fee to sell your timeshare. You may contact me at malmack@pacbell.net and I will provide his contact information.

I was contacted on Sept 26, 2012, by a Alex Santori, claimed to be an atty for Hotel U working on the buyouts. Said my contract is ready for an immediate sale as soon as I pay fees owed of $9,600. I foolishly complied. Since then I have not been able to contact him directly, although I reach a message machine for "Hotel U Marina and Golf Resort". It looks more and more like everyone is right, this is just a continuation of the scam. I contacted cox.net for contact with the Mexican lawyer for a possible class action lawsuit. BEWARE OF WISHFUL THINKING COMBINED WITH GREED!! I feel like such a fool!

There is a group of us that have been scammed as well. We are filing a class action lawsuit. All of those interested can email the attorney in Jalisco that is handling it for us. His name is Rodrigo Perez. His email is:

WHEN ARE ALL OF YOU GOING TO REALIZE THAT THERE ARE NO (ZERO, ZILCH, NONE, NADA, BUPKES) HONEST PEOPLE IN THE TIMESHARE BUSINESS. THEY ARE ALL CROOKS, PERIOD.

If you have some sort of burning desire to throw out your money, just send it to me instead.

Don't be surprised if you get contacted by someone who claims they can recover the money you lost to the scammers. It's just another scammer. Once you are put you on the " sucker list " they sell your name to other scammers.

David, I think your advice to me (DON'T BE STUPID) has inspired me, truly! FYI, I sent an email to member services asking for my $9,800 back. Within an hour, I got a message on my answering machine from Alan Dale, another voice from the past (IES). Finally, a response (haven't called him back yet). Also, contacted my VISA account and put that charge in dispute. Visa was very understanding, will mail me out some forms with witch to proceed. They have a special unit that deals with Timeshare scams! Lastly, I sent an email to the lawyer in Mexico regarding the class action lawsuit. It feels good to at least be trying to fight back. How sure can we be that HE is legitimate? (now I don't trust anybody!!)

Buyers be aware, there are 2 firms from Guadalajara who have access to your contract info and claim to be able to provide you with restitution of your funds. They are the "Mexico Advocate Team" and lately "Juridico Providencia - Fraud Investigation Unit of Mexico". They both claim that they have access to the seized asests of the Belaire/Hotel U developers. They most likely are in cahoots with the people of Hotel U. They both emailed to me an info sheet, Confidentiality Agreement and Signature Form to be part of the restitution. The 3 forms are identical word for word, except for the address and signature.

We fell for Mr. Dale's balcony. We suspect that all of our money is gone. However, we are going to pursue the case in the interest of some kind of justice.

Do not deal with the Mexican Advocate Team (Group). I suspect they are another scam.

The only governmental consumer advocacy agency in Mexico is PROFECO (you can google for contact info).

Be a bigger part of the Belaire/U Hotel Scam and get more information. Go the Forum Hotel Bel-Air Puerto Vallarta belaire golf resort and spa Class Action is now under way with no money down, you will be charged a fee on the money they get back.
