Thanks for the info about Guardian! Does any one know anything about Independent Timeshare Escrow? Any suggestions about how I can find out if they are legitimate?

I AM THE INDIVIDUAL WHO WENT TO CHICAGO TO CHECK OUT GUARDIANS ADDRESS. I AM GOING TO THE POLICE WHEN WE COME OFF VACATION. IT IS A TOTAL SCAM! ....WITH GUARDIAN I CHECKED WITH THE IL ATTY. GENERAL...THEY HAD NOTHING. I CALLED THE BETTER BUSINESS BUREAU IN CHICAGO....THEY HAD NOTHING, BUT THEY DID SAY THEY DID NOT HAVE GUARDIAN AS A MEMBER. I CHECKED WITH THEIR COMPETITOR, CHICGO TITLE....AND THEY HAD NOT HEARD OF THEM....EVEN THO THEY ARE SUPPOSE TO BE IN THE SAME BUILDING. AS FOR INDEPENDENT TIMESHARE ESCROW....IT EVEN SOUNDS LIKE A SCAM

We've been working with Capital One Visa and were very hopeful in getting a refund. However, it's not looking so good right now. Anyone else do the Belaire purchase with Capital One? If so, maybe we can work together to dispute. My dispute is legit, the time frame it the problem!

Belaire Golf Resort and Spa and The Hotel U or U Resorts is all a complete scam. They have stolen MILLIONS from investor "members" money and still try to milk us for more in exchange for fullfillment of our USELESS contracts. DO NOT SEND THEM A CENT!

Has anyone from the US tried to deduct their investment from their income tax. We went around and around with our accountant and you have to prove they intentially defrauded or stole your money and it is not easy.There are definite rules about this deduction. We were just wondering if anyone has tried this.

This is one of the many points I raised at one time. But, in construction, Bonds in relation to completion, performance, quality & workmanship are normally between the Contractor and the Owner.

The point that I raised at one time is, the Trust fund that is supposed to be a requirement by the City of Puerto Vallarta for Developers to ensure that they complete development projects that they start. This was supposed to be a regulation passed by the City because of those uncompleted buildings which became a sore eye on the City's scape.

The amount supposed to be placed in trust by a Developer would be equivalent to the estimated cost of the development. This trust amount is supposed to be held by the City until the project is substantially complete otherwise, the City will utilized the trust fund to have the project completed.

When we purchased our unit with Belaire, this was a Point that the Seller assured us which gave us a confidence into buying.

When our group of Frustrated Co-Owners submitted a Petition to the City of Puerrto Vallarta, this is the Point that we emphasized. So far, there has not been any action by the City. We wonder WHY? Copies of the Petition were sent to PROFECO, and other Mexico Government Departments and similarly, the Petition landed into deaf ears.

For all of us co-owners who got allured into this mess, please forward your complain by sending a Registered Letter to the Office of the President of Mexico. Copy their Toursim and Justice department as weell as Major Newspapers in Mexcio. It appears that we are against a well-organized developer with great influence and we need to wake up the various head of States in Mexico.

I understand about the completion bond, but did anyone check to see if that was actually what the city did, or is it just another spout of lies the Belaire told us so we would buy? We also took their word that we could stay at the Mirrimar without checking that they had nothing to do with the Belaire and never did.

In order to hopefully get the refund from a credit card purchase, it must be done within a 2 year limit...according to Capital One. They totally agree that we are worthy of that refund, but the time limit is past for us. All I can say is ACT FAST. We tried to give Belaire/Hotel U the full extent of their time to produce , but it has not yet happened. I continue to be in contact with Hotel U and have been assured (again) that they are trying to continue, but have been halted by the government because of the casino problems in Mexico City. They still hope to open by early 2012...and I was told that we will be able to book since they will honor our contracts from Belaire. We are still somewhat hopeful....since that seems to be our only option for the investment. We paid in full right away and our first year was to be 2010! who knows, maybe it will happen in 2012?!?!?!?!?!?!?!?!?!

You will never get your money, these people are not legit business people, they do not follow any rules, they are giving out our numbers to other fraudulent people to phone us and offer us scams to get more money from us in promises tobuy our time shares that are totally bogus. Keep on with your credit card company, if they wont give you a chargeback go for fraud since the place will never be built. Everybody who has not got there money back and used a credit card need to get their card companies together. The card companies are the only ones with enough clout to at least stop them from taking more money from people and maybe if the pressure was put on them they would take action to convict them of fraud. If you retain your own lawyers they will just bleed all of you dry as well and not get anywhere. The Belaire has a lot of money and they will not give any of it back to their investors.

thanks! So perhaps someone should begin to compile a list of those who have purchased and with which credit card companies. Sounds like we need a leader! Are you interested ? Or, is there someone else out there with the skills to get this together?
