I joined Zimmerman over a year ago. I recently got a Maint bill from TMC and forwarded it to Zimmerman. I won't write here what he said but it was good advice. I wouldn't pay ANYWAY!

Why can you not share Zimmerman's response ?. Was it negative? Would sharing it weaken our case? Many TMC timeshare holders have the same question for Zimmerman.

Can you send me his response to gpaccagn@verizon.net or call me @ 973-479-9763. I joined Zimmerman lawsuit about 2 years ago and may not pay my maintenance bill coming up in August. Curious on his advise. Thanks Gary J Paccagnini Time share owner

it would be imprudent for zimmerman or any of his clients to share legal (or any other advice) here on redweek. that would constitute revealing legal strategy and would put TMC spies ahead of the game. TMC monitors this site regularly looking for ways to combat legal plans made by zimmerman on his clients' behalf. we don't want TMC to have that advantage against us. they will continue to use any way possible to keep us financial prisoners. TMC began that process at the moment of sale/purchase of this timeshare, and hasn't let up their greedy ways up to the present time, e.g., the exponential and exorbitant raises in our maintenance fees.

I emailed Mr. Zimmerman regarding information on the case. He responded quickly and positively:

i repeat my recent response to a question similar to yours:

Hi Chris,

Thanks for your response and I agree with your opinion. I have joined the lawsuit and am hoping we can resolve these issues. I will make a call to the Zimmerman group and seek advice. Thanks again.

Errol B - Chris is spot on - this site is monitored so we need to be extra careful what is posted here. I, too, am part of the Zimmerman litigation and I think it has been a wise decision for all of us who joined - this may be our best chance to succeed in holding Eichner and his minions responsible for the fraud perpetrated on us.

If any of the 18,000 Manhattan Club timeshare owners have any relationship with Governor Cuomo, or with President Trump, it would certainly help if they assured that either of these elected officials are fully cognizant of what Eichner has been documented to have done to we the people, as well as NYS Attorney General Schneiderman's failure to remediate the crimes perpetrated against us. Anyone?

my guess is that neither administrator's priorities would be concerned with TMC per se and its fraud against us owners at the currently unfortunate times the united states (and the world) is facing.

however, TMC's current stance on holding firm on restrictions on reservation time without consideration of the coronavirus might make, at least mayor diblasio show concern. that remains a slim possibility in my opinion.

if a TMC owner wishes to report the issue of TMC's not altering reservation time due to the coronavirus, he/she might have a chance of being recognized. there's nothing to lose except some strokes on the i-phone or computer keyboard.

the above is not to say that you don't have a meaningful tactic on TMC owners' behalf, and that former nys attny general's failures in court were acceptable, but our officials need to put more important issues at the top of their priorities.

That's why my caveat is "if anyone knows" one of these two politicians. I agree that without a "friend" or business contact of Cuomo or Trump citing our predicament we will continue to be ignored, regardless of the potentially high profile crimes.

TMC has a cadre of well-bred new york attorneys who have all kinds of political connections, their "friends" if you will. also be aware that one of TMC's principals was once a deputy nys attorney general. your intentions are admirable but diminished by the current, unbridled legal power of TMC. my opinion is that future legislation by honest and intelligent attorneys and judges will eventually emerge, and the TMC empire will begin to crumble; we owners will reign, and to the victors belong the spoils. the adage, "there's strength in numbers," will prevail as long as we can assemble the numbers: we can do this by, as i said previously, presenting a strong and united legal front to defeat the fraudulent TMC bureaucracy. this can be done with strong consideration of owners to join our legal team. the law of averages suggests that we might even have brilliant attorney/owners willing to join our legal conglomerate to further fortify our strongly-deserved legal goal of retribution vs TMC's continuous fraudulent actions against us owners. the TMC board of directors, both sponsored and non-sponsored must be taken to task regarding our financially damaged situation as orchestrated by TMC.

I repeat Chris' warning. I have a civil suit against TMC that is waiting for an Appeals Court hearing. TMC lawyers brought to the court room copies of emails and statements from this forum. Do not put anything on this forum you do not want brought before the judge for TMC lawyers to use against you.

irene, you must realize how much all of us here are hoping for an overwhelming victory in your legal battle vs TMC.

TMC's spies have been stationed on this redweek site, probably since its inception. it's easy to believe that they will use anything and everything (twisted to suit their purpose) gleaned from this site to use against us in court. thank you for reiterating my warning about not writing any strategic information regarding our legal actions on redweek.com. that's excellent advice for the reason you cite.

I was listening to the news today and there was a report concerning the Disney vacation timeshares and Hilton vacation timeshares. Both companies are making adjustments and showing consideration and understanding for their owners. Letting weeks/points carryover till next year, not charging any late fees for payments and canceling scheduled vacations with no Financial penalties.

hello kevin,

perhaps disney and hilton have some class along with empathy and sympathy for their owners/clients (the people that keep them in business.)

somehow, i can't assume that TMC will follow suit by making reservation adjustments to carry over till next year as covid-19 (coronavirus) has a chance of being mitigated and reducing its pandemic status by that time...."not charging any late fees for payments and canceling scheduled vacations with no Financial penalties." that kindness and understanding has never been shown to be part of TMC's psyche or modus operandi.

on the other hand, we would all appreciate a dose of milk of human kindness from TMC during these times of strife and life and death covid-19 environments. this could enhance TMC's status toward being a more humane and understanding HOSPITALITY-ORIENTED organization. should we look forward to that happening? it would be a refreshing occurrence for TMC to notify its owners of the essential, generous and temporary adjustment of its reservation policy until covid-19 is more under control.

(i recommend that all of us email gabrielle dzwonkowski with similar requests to allow us to carry over unused time, without penalty, and offering us reservation time extensions due to the covid-19 life and death pandemic. proactivity is a must. in your email to gabrielle, consider adding cc's as follows:

timeshareboard@manhattanclub.com; the "timeshareboard" address is for all regular TMC board of director members;

and the following non-sponsor board members...patti.tmcny@gmail.com; jdunphytmcny@outlook.com; bbb174@aol.com. the non-sponsor board members are, respectively patricia soltys, james dunphy and robert ballot; they are all TMC owners, just like us!!)
