Re: Re: CANCELLING A DEVELOPER BOUGHT TIMESHARE IN FLORIDA ...

[Q=mayz5] we bought Timeshare in South Bay by Exploria in Florida. We would like to rescind. My hubby was not completely sold out . Any one who bought from this company? Please share your experience.[/Q] Florida law provides you with 10 days to rescind (cancel). Don't wait for "shared experiences" here --- JUST DO IT! Cancellation instructions were provided to you (as required by law) right at the time of contract execution. Those instructions could be in writing within the contract document, or they could be separately "buried" within a CD-ROM or a flash drive provided to you when you signed the contract. One way or another, you already possess all the information you need to cancel the contract. You must rescind in writing, under original signature (no phone calls, no emails). Best to send your rescission letter by certified U.S. Mail, since this will produce a date stamped receipt from the USPS counter, documenting a postmark date within the available rescission period. The actual delivery / receipt date does not matter. All that matters is that your rescission letter is postmarked within the 10 days provided by Florida law. Don't delay. If you snooze, you lose.
