The latest results from the NY AG vs TMC court case from a TMC owner who is also an attorney. The Court’s decision on the injunction motions. Basically the NYAG wins almost everything—all the injunctions stay in place and Urban is now also enjoined. The only thing the court does for tmc is to say a hearing must be held on the NYAG’s motion for civil contempt as tmc seems to have made some arguments that need a further hearing. Also—the court refused to limit the NYAG’s discovery or allow tmc to complete the sales of units to purchasers , which were halted due to the 2014 order for injunctive relief. Tmc lost almost all of their arguments and the judge is beginning to show that she “gets it”. My bet is tmc takes this decision up on appeal (if it is possible to do so in the middle of the case). Briefs are now filed on the discovery/deposition motions—hearing on 6/14. My guess is that tmc loses on these motions as well.
