I believe the buy-back agreement states that you will not pursue any lawsuit against M.C. and it's partners. They don't want to be held liable and that's the only way they will participate in the buy-back (give-back). Just decide if you think it is worth it to you and proceed with your best interests. For me, I stopped paying Maintenance Fees and got moved right up the list, which was forgiven with the buy-back.
