Actually the suit was not dismissed. Here is the latest correspondence I received from Mr Zimmerman:

We are still waiting for the Court to rule on the motions to dismiss that defendants filed last November and that have been fully briefed since January of this year.

We’ll let you know as soon as the Court issues its ruling.
