I spoke to Jean Marc Zimmerman Friday to get an update on the status of our lawsuit against TMC. Contrary to several erroneous postings I have seen, our suit is very much alive. About a year ago, TMC motioned for our suit to be dismissed and Zimmerman responded with a forceful rebuttal. We are waiting on the judges decision on the motion to dismiss to see if our case can go forward to trial. Jean Marc asked for a conference with the court to discuss the delay, which was held in February. The court apologized for the delay and told him a decision was forthcoming. Jean Marc is willing to wait another 4 months for the judge's decision and then might have to take further action to get a decision rendered. JM says this kind of delay is NOT UNUSUAL these days ( a year or more) The wheels of justice grind slowly, but at least they are still grinding! Bob B.
