We lost an appeal to the Second Circuit of a dismissal of our Federal RICO case last month. We have now updated our complaint and filed suit in New York County Supreme Court (state court) for breach of contract, tort, etc. The complaint has not yet been served, and we see strategic advantage to maintaining the complaint in a low-profile status at this time. We would appreciate it if you would not publicize this message. In the meantime, we have reached out to the Eichers and Hilton/BlueGreen to open settlement discussions. Neither effort has advanced, but discussion with counsel for Hilton/BlueGreen are ongoing. If discissions fail to advance, we will serve the Complaint and proceed with the litigation.
