Your contract clearly states that the up-front fee for your service is nonrefundable. It also states that you cannot guarantee results and details a raft of responsibilities me, your client. Breach of any of these responsibilities would seem to provide you an out. Basically the contract says 'Pay me the non-refundable fee, and I will do some minimal amount of work for you. Since recovering funds is hard, I won't take any risk and I need to make sure I'll make my money even if I can't accomplish anything for you.'
