Re: Has anyone purchased from Vallart Gardens? (by Pam E.):

Way to go Deborah--I was commenting back in 2013 re: our purchase of a one bedroom back in Dec 2012 and I had stated that we were disputing our contract with actually 2 credit cards: Visa and American Express because we had used one for half and the other for half. It was a long hard time consuming process but we did win both of our disputes with Visa and AmerExpress at the end of of the year...after starting them it was about 8 months and we did lose both of them on the first try but Appealed both of them. We actually won the Visa one first (which I didn't expect because everyone said you won't win the Visa one but you might win the AmerExp). But AmerExp finally sided with us on a legal technicality that I had proof of on an email. I'm just so glad it's over! And I'm assuming that the contract is VOID if we got all our money back because they won't let us have the contract for free. They never responded to our request for cancellation of the contract in writing after we got our money back.

I am happy to report that my credit card company decided in my favor over this unfortunate purchase, and I finally received my money back last week. It was a long process, and it got denied once, but when August rolled around and there was no sign of any studio units even in the process of being built, I was finally able to win on the fact that they didn't deliver the property I purchased. So, if you purchased a one bedroom or studio, and you paid with a credit card, you still have a chance of recovering your money. If you purchased a two bedroom, then probably not, since they did build those. It's unfortunate that they have been so unscrupulous in selling this property, because it certainly had the potential to be a great place to stay - which is why I fell for their sales tactics in the first place.
