Buying, Renting, and Selling Timeshares

HELP. Deeded Time Share Purchase from Diamond Resorts

My wife and I have been owners at Kaanpali Beach Club for approx 10 years (purchased when it was an Embassy Resort). Last year, I came across a time share for sale, every other year (odd). Same resort, deeded. Same room designation that we have. I purchased this for our son to use. That was in August, 2010. To date, Diamond has not transferred the ownership. In October, the escrow company still had not heard back from DRI regarding their first right of refusal. In November, we received the documents to be signed/notarized. DRI never did respond. Those documents were returned in November. The deed was forwarded to Hawaii for recording in December. We received the recorded deed towards the end of December. We are now 7 weeks into what should be our first year of use with no response or transfer from Diamond. ANY SUGGESTIONS? The escrow company claims they keep calling. Should we be compensated somehow for not being able to use this as of yet? Lengthy, I know.....but............input will be greatly appreciated.

If you've received the recorded deed then I don't see what the problem is .... the week is evidently in your name .... or am I missing something?

From what I understand, the resort has to transfer the ownership which they have not done, nor are they responding to the inquiries from the escrow company.

In that case you can make a copy of the recorded deed yourself and send it to the resort.

the resort has it. they are not completing the ownership by transferring it.

If the resort has the transferred deed then it's their duty (legally) to put that deed in your name, period. If they don't comply then threaten them with legal intervention.

Thank you. That's exactly what I will be telling the escrow company to do! This has been in escrow since August! Thanks for all the comments, info, etc.
