Buying first time share need help with how to take title

Dec 12, 2010

Hello

I am about to buy my first timeshare (Marriott Kauai Ocean Club).

My parents currently own two Marriott weeks. Which they own through a family trust. One of those weeks (Kauai Marriott) they use themselves typically in the non peak season. The other week (Marriott Maui Ocean Club) they bought for my sisters and I to Share.

We want to be able to take advantage of Marriott's 13 month reservation policy for multiple week owners so we can get prime summer weeks. And my parents want to continue to book their week in a non season.

Anyway, what do people recommend. I guess I see a couple of options.

1) I could ask my parents to transfer title of the Maui week to me. Can they actually leave legal ownership in the trust and just change the owner of record with Marriott for reservation purposes. 2) I guess I could put the Kauai week I am about to buy into the family trust. Will Marriott be able to distinguish between my week (bought in the secondary market) and my parents' weeks which were purchased directly through Marriott.

I know that even though the Maui week is owned through a trust, my folks need pay a fee to put the reservations in my name or my sisters names, so clearly they are some how shown as the owners even though title is held in the name of the trust.

Any thoughts would be helpful.

Oh my goodness, you've come to the wrong place to discuss family trusts .... you need to consult a lawyer that handles such.

- This is a very simple process and will not require a refiling of deeds at the bureau of conveyances.

2) I guess I could put the Kauai week I am about to buy into the family trust. Will Marriott be able to distinguish between my week (bought in the secondary market) and my parents' weeks which were purchased directly through Marriott.

- Marriott does not penalize a person from buying on the secondary market. Their internal records will allow for the distinction you are looking for.
