How can I rent a timeshare?

Sep 16, 2007

I'm very new in this field. How can I know that I won't be cheated by others when I rental a timeshare? How about the payment for the rental if the citizen of both are different?

I have never rented my time share before and was interested in doing so. However, after reading some of these forums, I am a little concerned that this may not be the thing to do. It seems like it may be wrong, a little illegal in fact! Like I may be committing a crime with RCI or something! PLEASE HELP!

You can rent your owned timeshare, but you can't rent an exchange that you've made via RCI or II.

You must use a rental agreement with all terms of the rental stipulated. You can find a rental agreement in this forum under Sample Rental Agreement.

===== Good question. Have any of you folks reading this rented to (or from) a person in another country? I have rented out our Mexican resort but since it was to another American there was no currency exchange problem. I'd suppose major banks can supply something like a Cashiers Check for payment at the current exchange rates. However, this might be a circumstance in which an escrow company would be useful. Comments? MD

PayPal handles payments to and from over 100 countries. There are similar services such as Ecocard whichis very popular with Europeans, I'm told. Funds can also be wired into a bank account.

Please visit our page on payment comparisons, http://www.redweek.com/help/payment-method-comparison.

We always recommend that you use a vacation rental escrow company when renting but this page will give you choices for you to decide what is best in your situation.

Nice contract JJ. Especially like the term "Inbound Guests" and getting the names of all coming. The ages might not be a bad addition. MD

Do you have a draft contract I could use to rent my timeshare? Any prior draft would be helpful as a guide. Thank you

With the wealth of knowledge and experience out there, can you share what you see are best fair practices that best protect both the renter and the owner.

I'm more interested from the renter's perspective right now, but maybe one day I'll be renting out the T/S that I own and be interested in the owner's perspective.

Thanks

Perhaps the thread below will help you:

I have used the Timesharing Today Magazine "Document Kits" for years. It contains three complete sets of fill-in-the-blanks lease forms, with worksheets, detailed instructions, and model letters to send to the renter, and notifying the resort. These forms were prepared by the owner of the magazine, who is a practising attorney in New Jersey.

When you arrive at the home page at www.tstoday.com look in the left hand column and you will see "Document Kits" (bright green box). Click on the link to the rental kit there, or go directly to: https://tstoday.com/shop/docKits.aspxand

The cost, if delivered by regular mail, is $10. for 3 kits. The price is even lower if you choose to download it instantly.

(Timesharing Today also sells a "Resale Kit" for $35.00 Use the same link: https://tstoday.com/shop/docKits.aspx)

While you are at the website, you can order a free trial issue of their magazine, which is published 6 times a year. They have great articles that you will not find anywhere else. Their logo is: The Trusted Independent Voice of Vacation Ownership since 1991."

Better yet, consider ordering a one year subscription, which comes with a 100% satisfaction refund guarantee. If you become a subscriber, you will receive a user name and password (which changes every 2 months) that will give you on-line access to all of the articles they have published over 10 plus years.

I have no financial or other connection to this company.

I have just been a happy subscriber for 12 years.

Do you have a draft of a rental agreement that I could use as a guide. I rented my timeshare and need a draft agreement. Thanks Harry

I'm having so much trouble renting my place in Maui. It's in the brand new Westin, we're asking half-price compared to the official rate and it's for the Thanksgiving week.

I've posted it here but I've hardly had any interest. Is there a secret that I don't know about?

Edit: didn't see the post above; i'll check out that link.

Have you checked what other people are asking for their rentals at your resort? Also, I wouldn't necessarily go by the resort rack rental rates in coming up with a price for my rental as rack rates are are normally very high.

Thanksgiving should be a very popular week and you own at a very high end resort (Westin), but Thanksgiving is fast approaching. The only advice I can give you is to lower your rental price or deposit your week with an exchange company so as not to lose it.

============= You didn’t say how long you’ve had it listed or when you reduced the price. Many people plan holiday vacations several months in advance. If it’s a fairly new listing, people may have already made their travel plans. At this late date, airfare also becomes a factor. For example, airfare to Hawaii from the East Coast can easily approach $1000 per ticket during the holidays. I noticed in your ad you listed prices for the lock-off units, which are less expensive. You may want to consider editing your ad to list either the 1 bedroom or studio as the primary unit. You might have more opportunities to rent the smaller units. As a last resort, you may need to lower the price to an amount to cover your maintenance fees. Good Luck

Move your week to a more desirable time of year, like January/February,when the Holiday season is past. When the mainland weather is NASTY,vacationers are far MORE willing to pay a premium for a World Class tropical resort like the Westin Ka'anapali!

I rather imagine a lot of people searching for a vacation week on Redweek are "turned off''' when they learn they must pay for the right to contact the owner who is trying to rent a unit as well as paying the rental price. Many will come to a screeching hault when asked for a credit card number. We who try to rent out weeks on the site might do well to pay a little more to advertise and have the customers contact us at no cost to them. Yes, I know that a fee discourages the less than serious lookers, but it stops some serious one too. MD

You must use a rental agreement signed by both you and the renter. A sample rental agreement is below. If you did not use a rental agreement I don't know of any recourse you have in getting your money from a renter.

SAMPLE RENTAL AGREEMENT RENTAL AGREEMENT

RESERVATIONS - Upon mutual agreement of unit rental, a ____% deposit must be made to confirm your reservation. Balance is due upon written confirmation or no later than _________, 2007. Payment is to be made with a bankcheck/draft (or a personal check if you accept that mode).

CANCELLATIONS - No cancellation allowed once a reservation has been made.

CHECK-IN/OUT - Check-in time is _____ P.M. on arrival date of __________, 2007. Check-out time is _____A.M. on date of departure of_________, 2007. Any exceptions must have prior approval from the owner and/or resort. The agreed upon rental price for the above stated timeframe or week of ______, 2007 is ________$ for unit number ____ at _________ (resort).

RULES AND REGULATIONS - Upon check-in, you must present a credit card to the front desk personnel, just like when you rent a hotel room. YOU are responsible for any damage, loss or theft incurred while renting this property. Any damage, which is not considered normal wear and tear, loss or theft caused by you, the renter, may be charged to your credit card. In order to reserve the integrity of the unit, we ask that it be occupied in a quiet and dignified manner. As guests of ______________(resort), you are expected to respect the premises and its contents and guard against damage, loss or theft. You are expected to adhere to all of _______________(resort) rules and regulations. The _____________ (resort), its employees and property owners will not be held libel for any claims, suits, damages, costs, losses and/or expenses arising from injury to any person or property occurring on the premises resulting from/relating to rental of this property. The renter must be at least 21 years of age and agrees not to sub-rent this unit. The rental rights acquired from this rental agreement are non-transferable.

TELEPHONE - All telephone calls, toll calls etc. will be billed to your credit card. NO PETS ALLOWED AT______________ (RESORT) AND NO SMOKING ALLOWED IN THE UNITS. A copy of this rental agreement is hereby acknowledged by both parties.

I respectfully disagree. I was reading on Tug just yesterday about a person who placed an ad on that site and then getting all kinds of spam in their email. Ad email addresses are listed on all Tug ads for anyone to phish .... you don't have to be a member of Tug to phish an ad email addresses.

Here at Redweek, I have not seen anyone who has placed an ad here that has been bombarded with spam because you have to be a member here to access personal information and email addresses. This protects the members of Redweek that place ads here.

The people that access Redweek are serious about rentals and sales, they are not merely phishing for personal information. I personally would be glad to pay the small Redweek fee to keep my personal information away from scammers and spammers.
