I know what you are going through, MaryBeth. I've had the same results and experiencies with Resales Buy Owner and started this forum on this company in June, 2008. I would think if anyone knows a capable attorney, this would be a good case for a class action suit. I don't understand why the attorney general in Florida has not cracked down on these people--they are nothing but frauds and scammers. Patrick Hollingsworth gave a great sales pitch, told me about his family and even gave me his "personal" cell phone number--I have yet to get a return phone call.

Does anyone know whether you can write any of your timeshare cost on your income tax? We were told that we could deduct the closing costs, and since it was a deeded property, you can deduct the maintenance fees. Any knowledge on this?

I have never heard of this and I don't believe it's true .... proceed with caution.

Only time you can write off your maintenance fee's is if you rent your week. You can write off the fee plus charges to run your ad to off set some of the income from renting only.

NOT TRUE on deducting closing costs under ANY circumstances.

You can "deduct" the property taxes portion of your bill in the years in which you pay that bill. Some states (CA, for example) send property tax bills as a separate item. In other states, facilities often just separately list the property tax amount within their maintenance fee billing. If they don't, you then have to find out that property tax information from the resort or its' management company.

The only time you can actually "deduct" maintenance fees is when you routinely rent out your property. Even then, you can do so only against the income you receive from that rental --- that is income which you are obligated to report for tax purposes.

This may not be what you want to hear (and please don't shoot the messenger), but a "signature" is not actually required to create and execute a valid contract. If you voluntarily provided payment for a "listing" and your timeshare has indeed been "listed", then a valid contract has been executed.

If you paid by credit card and you want to TRY to dispute the charge (all credit card companies have specific time limits in which to do so, however) that is probably your one and only shot at getting your money back (and it's a long shot). These types of parasites are in the business of collecting your money --- not returning it...

As Ken stated, the fact that you willingly gave them your credit card number may hinder you from getting your money back, but if you signed no contract then you may have a legal leg to stand on ... you might want to get in touch with a lawyer .... just don't give up.

I am also a victum thinking Resales by owner was legit. My problem is that I fell victum to another offer from "Buy a Timeshare.com" My total loss was $950 between the two. Cynthia, at Buy a share does not return calls and customer service with Resales does not retun calls. I do not expect any results but I would advise any one dealing with these two companies to go elsewhere.

I am very disapointed in this company. I feel they just took our up front money and didn't do anything to earn it. They put an ad on there web site, they tell you that they are going to show case your property & get cash bids with the week, I have heard from this guy maybe 3 times since June and have gotten the same old story after repeated phone calls that people are having a hard time getting approved. I have left messages and they haven't returned my calls. I would stay away if I were you!

Until you report this scam company to the attorney general in the state in which the company is located, then you can kiss your money goodbye ... it really amazes me that we've told people time and time again to file a complaint with the AG, but they turn a deaf ear.

Two upfront fee scam companies have recently been closed down by the Florida AG and a lawsuit has been filed.

Hello, I am so relieved to see that we are the only ones foled by this company. We put our trust in them and worst of all, they never return calls or e-mails. We lost a good amount of money to this company. We had listed it for sale as well to rent weeks. We were told that our agent had three checks for us. Aftere several weeks went by and still no checks we called again. After weeks again of waiting for reply, again we were told "oh , so sorry, she was away, but that , again, she had checks for us. This has beenn going on since last summer. Now we can not even get a response. What is more disheartning is that I thought I was doing a good thing and taking care of business while my husband was serving in Iraq. Of course they assured me that my credit card bill would be paid off before he came home. Well, he's home now and we are still paying off the credit card bill. Than goodness he has forgiven me but feels like I do that this company needs to be dealt with. The fact the they lterally steal money from innocent people who put their trust in them, especially playing on the emotions of families that have loved ones serving overseas is is just utterly disgusting! We are willing to join a class action suit to stop this company from taking people on a ride. Thank you to all who have taken the time to read this. SFC Cliff & Arlene Snedeker

File a complaint agsinst the company to the attorney general in the state where the scam company is located. This is the only way these people will be put out of business .... two upfront fee resale companies have already been put out of business by the Florida attorney general and a lawsuit is pending.

Who was the company that you went with? These companies need to be exposed! I'm working with a company right now that swears that they have sold my timeshare and we should get a check no later than the 2nd week in December. I have talked to them on a regular basis and the rep always calls me back. I will be a believer when I have that check and he knows it. Let me know what company you were with!

I would like information to contact the Attorney General regarding Resales Buy Owner also, Cheryl Clay as well. My initial contact was with Michele Greene, Same story - no return calls. If anyone has that information, I'd truly appreciate it.

Thanks for providing the contact information for the Florida Attorney General. I have sent a complaint to them regarding Resales Buy Owner. On another note, is anyone familiar with the companies that will relieve you of your timeshare (if you already own your timeshare, you pay them upfront to take the timeshare from you, transfer the deed over, relieving you of any future maintenance fees). Is this ligit? I'm so scary now about the upfront fees again. Appreciate any feedback anyone has.
