Manhattan Club Lawsuit

Can someone familiar with NYAG settlement advise-I thought Eichner("sponsor")was to leave the picture at end of 2020 under the agreement.Recent club communication(annual meeting) shows no change from the past-sponsor still has 4 board members,and owners have 3(non control),millions of fees still being given to sponsor,etc.Doesn't AG monitor compliance,or was there amendment/change to agreement?

TMC has different contracts with different trading companies. Only the PH units can trade with Interval International. The PH units cannot trade with regular RCI.

We wrote and told them we would no longer pay the fees. Miraculously, after being on the wait list for 2 years, they got back to us lickety split. Good luck to all. This has been a genuine mess. could have been a great place to have were it not so expensive and unattainable. Can't even trade it for anything, Good-bye Stuart Eichner. God is watching you!

I have been on the buy back list since 2014, stopped paying maintenance fees 2 years ago, still have heard nothing about a buy back. To whom did you contact to move the process along? Thanks

It is amazing how many owners on this site after years of conversation are so ill informed and/or believe all the "sea lawyers" and "wanabe real estate experts". Since many haven't read their TMC contract or failed to comprehend the same or not reviewed steps with a real attorney to sell, trade, donate or give away your TMC timeshare here's the simple fact.....you cannot do so without prior approval of TMC.

Unfortunately life is not fair and eichner has lots of money and attorneys in his court. In the eyes of the NYAG, they “punished” him. It was an investigation, not a lawsuit and thats over. Also, there is no lawsuit. This site was erroneously named and they couldn’t change it, we were told. Currently, a lawyer named Zimmerman has taken on clients, owners of TMC, and is working on their behalf for a fee, though we've been told its not technically a lawsuit. You could try that avenue. A real estate lawyer on this site a few years ago said to will it the State of NY. I want to point out that I paid the average of $3000 for 8 years. That would have been the cost of one timeshare.

I didn't have to contact anyone. They contacted me with the offer. They have bought back (given away) 3 weeks that I owned at M.C. I still think they will contact you. If you've already stopped paying, they will get someone in that they think will pay.

Correct!!! TMC has first right of refusal. You cant do jack unless they approve it and or offer to buy you unit (s) back.

When you inherited from you mother, did you live in NY? I inherited from my mom and as executor I am seeing that I may have to ancillary probate her will in Manhattan and hire a Manhattan attorney. Did you run into this?

If they "buy back" the deed, do I have to probate this in NY prior to my signing the deed over? Or as executor can I just sign it over.

What a mess!

A RedWeek post from a practicing New York estates lawyer I saved: stevenw on May 02, 2017 06:01 PM. To all those inquiring about your heirs being saddled with this albatross: I have been a practicing estates lawyer in NY for nearly 50 years. The information given to you by Laura (I believe her name was) was basically correct: your beneficiary cannot be “forced” to inherit (and therefore have to pay for maintenance etc.) for the timeshare. The legal route is to execute a disclaimer within 9 months after death, and make sure that you do NOT accept the timeshare by using it or otherwise indicating acceptance (e.g., trying to sell it as if you own it). However, each state has its own laws as to how one disclaims. ……Note though: the (resort) can then also disclaim it, so there are some further fine points legal steps that must be implemented in your Will or trust to deal with that possibility. But most definitely your heirs are NOT bound to accept the timeshare and make the payments if a proper disclaimer strategy is included in your estate planning documents.

Stopped paying. After 1 year they sent me the papers and I signed it back to them. Got confirmation that I’m no longer responsible for the property. I should get my $100 in 6 months.

Hi Paige, I want you to know that I responded and provided the same info as Irene. For some reason my post didn't submit even though I did hit submit. This is the 2nd or third time this has happened to me. I'm grateful to Irene because I just couldn't type all that over again. To answer your question I lived in MA, Mom lived in VA and the time share was in NYC. I was told I had to file an ancillary probate. I got told lots of things that cost me a lot of money. If you are offered a buyback by TMC, ask them about the ancillary probate because that will come into play when they do the buy back paperwork. Don't do what I did and have the timeshare put in your name. I came to the conclusion that it depends on the State you live in, whether you have to file an ancillary probate. Listen to Irene and get a very good real estate attorney, in your State, to help you with this. I wish you much luck! I went through this in 2013 and it was a very costly nightmare. I hope yours will go more smoothly and will be less costly. Just as an aside, as part of the ancillary probate I had to hire a company to value 2 timeshares. They valued them at 20 and 30 thousand respectively. We all knew at the time they were worth nothing. I was allowed to write them off on my taxes as a loss.

Paige, I was told in VA that I could either refuse the timeshares or my whole inheritance but not both.

Hello. I'd like to learn how you were able to sell it back to TMCNY. I tried doing that 4 times and nothing. Then I listed my 1 bedroom for a year and nothing. Fees are now up to $3,200 a year.

I've been trying to reach reservations for a week now and no one will answer the phone. I've tried 3 different numbers including the front desk. It says "Please hold" then the call drops. Or message says there's no one there to answer the call. Any one else having this problem??? They hounded me for our maintenance fee for 2022, but now no one there to make a reservation?

I'm going to stop paying and sell (ha) back to TMC. Can I maintain my RCI membership or is it predicated on TMC ownership?
