Manhattan Club Lawsuit

Oct 26, 2021

Hi, After many years of visiting the MC, we stopped paying this year after our family income was reduced during COVID. I'm starting to receive calls and mail for payment, any thoughts on when to request a give-back?

Why has the attorney not prepared for this action by the judge. Another stall, more money needed, now try again, and yet more people are encouraged to take the buyback, Eichner gets control of TMC and avoids Attorney General ruling to have no dealings with TMC. Why has the attorney not notified the judge of this violation? The whole legal system is working against the TMC owners. When is National media going to hear all of this, put it out for everyone to know the truth? End this nightmare once and for all.

Larry O. since you have already stopped paying your fees, I would ask for buy-back the next time the M.C. calls and every subsequent call. Let them know that you don't see anyway that you are able to continue making payments. Once they see and acknowledge that, they should offer you the buy-back. I've had 3 units that have been bought back from M.C., so I speak from experience.

Why was the attorney for this response and remind the Judge that Eichner is in violation of ruling of NY Attorney General to have no involvement with TMC. Owners are encouraged to take buyback $100, put more money in Eichner's pocket. We have lost to the legal system, and only the lawyers are profiting. The National Media needs to hear this story, and everyone will finally know the truth. Let the owners stand up, protect their investment. and end this nightmare.

Just call Danielle Webb directly @ MC. She’ll take care of it. Ignore all other calls and threats.

I am part of global media, writing for Inside Timeshare, published in Spain where perpetual timeshare contracts were made illegal. I would be happy to write an article about the seemingly never-ending MC battle as it was proclaimed in 2017 a great win for consumers. I have been following the story for the last several years, this published in August of 2017. I do have access to a few respected journalists from real national media.

I was in contact with attorney Douglas Wasser back then. I remember Douglas telling me that hundreds will be helped but there were thousands harmed. I think that is what he said, but I'm sure he would be willing to offer a comment. My cell number is 270-303-7572 EST and my email ireneparker377@gmail.com if anyone would like to share their story of what has transpired since the $6.5 million settlement. Irene Parker

So, how does one go about initiating a buyback by the TMC?

Please contact Irene Parker and tell everyone you know who is an owner to get in touch with her. She can spread the word and help us. She has posted her contact information on October 28 on the Redweek message thread.

We have yet to receive our check for$100 for each of the weeks we purchased, waited forever to get on the list,,, Eventually, after refusing to pay the maintenance fees. they took our weeks back. Now awaiting my check, It’s been about 6 months now. Very frustrated with this place.

Susan. Be careful what you post on Redweek as TMC reads the posts and keeps records. Better to communicate directly with individual if possible. Regards

Just wondering if I bought my timeshare week originally for $28,000 and receive the $100 for the property buyback since it is a property in NYC can I take a $27,100 loss on my taxes for the 2020 tax year

I was able to BUT you have to get it appraised. That costs money. In 2014, I had both of mine appraised, for reasons of inheritance, cost me a few thousand dollars. They were appraised at 20 and 30 thousand respectively, even though we knew they were worth nothing. But since I had a valid appraisals, , I was able to declare the loss..

Based on my information you can claim a loss if you owned them as an investment and rented them out. If you purchased them for your own use, you can't.

Jim I spoke with TMC Today. An owner said there was a program to deed-back for $100. The person I spoke with at TMC said to call this number and extension:

TMC Financial Services 800-532-4566, ext. 8391

Let us know what they say.

Jo Ann, To my knowledge, no timeshare company will award the owner a reimbursement, or even accept a voluntary surrender, if maintenance fees are not current. At least you won't have to pay 2022 maintenance fees, which are about the same amount as renting a week online.

Scott, Unless someone on this thread is a CPA or tax preparer, don't heed their advice. Talk to your CPA or tax preparer as every tax filer is different. If you do your own taxes, consider hiring someone because of this issue.

Manhattan Club is taking back (buy-back) ownership weeks that are delinquent all the time. I was 3 years behind in mine and got the same $100. as everyone else. My recommendation is to not give those thieves any more of your hard earned money. M.C. took advantage of all the owners for years and years.

It takes a year. They told me that up front
