Manhattan Club Lawsuit

Lately there has been little from the one time vocal contingent which argued against. Is their still hope, especially from most recent suit ( a year or so ago) which held out hope. ThanksAs I have always maintained, it is a very personal and individual decision. Some people want to continue to fight. They don’t want to lose their investment and allow Eichner and his cronies to continue to get away with what they have. I can understand their point of view. I, on the other hand, had inherited 2 time shares, could not afford skyrocketing maintenance fees, did not want potential inheritance issues lasting in perpetuity and I didn't want to be tied down to going to NYC every year for two weeks. In addition, I didn't want to throw good money after bad by getting involved in lengthy lawsuit with no guarantee of a timely and satisfactory outcome. We already had suffered through a 4 year investigation with an additional 3 years waiting for them to dole out a pittance if any restitution and Eichner still getting away with fraud.
I would like to add that the vocal contingent to whom I believe you are referring has most probably been advised to not post on this site by Mr. Zimmerman for obvious reasons.

I obviously follow the threads.. the only input is that this has been going on for so much longer… I am out but struggled to get accommodation since the early 2000’s..I approached the unavailability of staying but was told it was popular… it’s been a nightmare since 1999… currently watching as I am interested to see what happens..It’s not great as I’ve been following for a while. It’s hard to admit that I’ve been done over but it’s true..apologies to all in the same situation..speaking as a foreigner…

William M, Who did you talk with to get the paperwork sent right out? Or what department? I can't seem to get to the right people. I see people have been on a list for a long time before they get the paperwork. I am in the same position as you were being current on maintenance, no late payments, no mortgage. I also enjoyed a dozen years, but can't justify the fees.

Aha! Got my $100 Saturday, 8 months after the paperwork was done. History: we stopped paying maintenance fees in Jan 2020 and got a threatening letter, asked to be put on the "buyback list" in June of 2020, got another bill and threatening letter Jan 2021 (they will start collection process), then got a different letter in May (we can give it back for $100 or they will pursue collection), paperwork for "buyback" arrived and was filled out in May 2021, then got emails saying we're no longer an owner. Took another 8 months to get the check but I see the title has still not changed.

Is it possible that New York's new Governor Hochul would do the right thing and look into this for us? If I recall, the DA who prosecuted this case against Eichner was arrested for a sexual assault claim and settled this case on our behalf with no recovery! And without shutting Eichner down!

It was the New York AG, not the Governor who was a sexual pervert, if I remember, a cross-dresser. The NY Governor was just a sexual predator. NY AG Eric Schneiderman did settle with Eichner for $6.5 million which was nothing considered over $100 million obtained via maintenance fees paid to a shell corp according to Irene Smalls' research. And that did not include 90% of rental income. The then AG did get them to agree to be banned from the industry but Bluegreen screwed that up by reversing their decision to obtain TMC management. https://ag.ny.gov/press-release/2017/ag-schneiderman-announces-65-million-settlement-midtown-manhattan-timeshare

I have a fix week and a flex week. I chose to pay for the flex week in January but I put off the fix week for New Year’s because I have financial obligations. Manhattan Club financial services keeps calling me to see if I want to give back that fixed week to avoid foreclosure. Does anybody know how long it takes for them to actually put forth the effort to do a foreclosure? I want to string them along as long as I can because the amount is just too large for me right now. ( I have explained this to them)

No negatives on my credit report. But I’ll bet there are a numbr of negatiaves on theirs~!!!! Manhattan Club was a scam...nothing more. Bad management. Although we loved being in NYC, we could no longer justify the outrageous maintenance fees. We can rent cheaper as a non-owner.
