Can you send me the link to the NYAG website where TMC was found guilty of fraud please. I used these talking points when they called to harrass me about my maintenance payment and she said, "we were not found guilty". I hung up on her, politely.

Technically they entered into a settlement agreement with the NYAG. They did not go to trial, so they were not found guilty in a court of law. But they did admit to several 'wrong doings' as part of the settlement. If you google it there are links on the NYAG site like this press release from 2017:

In November, 2021, Jean-Marc Zimmerman and Steven Hoffberg filed an amended complaint in Acklin et al. v. Eichner et al., Civil Action No. 1:20-CV-07042 pending in the U.S. Federal District Court for the Southern District of New York on behalf of many plaintiffs, alleging as a basis for federal jurisdiction violations of the federal civil RICO statute. Defendants promptly filed a motion to dismiss, which was responded to over one year ago in January, 2022. The court clerk recently affirmed that the motion remains pending, but unresolved.

We have also communicated with Louis Solomon, Chief of Enforcement, NYS Office of The Attorney General, Real Estate Finance Bureau (212) 416-8109, who did not provide us with significant information about the “ongoing” TMC investigation. There is apparently a monitor appointed per the AOD, but Mr. Solomon did not disclose his name. Mr. Solomon was, however, interested in receiving further evidence of fraud or impropriety at TMC.

We intend to attend and participate in this year’s annual meeting, and encourage all members to attend, and raise your concerns publicly with the Board.

I spoke to someone inside the MC who informed me they had not sold a unit since 2014, they were supposed to be acquired by or merge with Bluegreen Resorts who wanted to add TMCNY to their portfolio for their owners. When that went awry in 2021, they stopped taking returns of timeshares which is about the time my brother gave his back.

I asked where I was on the list to return (went on in July '22) and was informed they could not provide a date when I would be able to dump my timeshare which I have owned since 1997! I paid $9000 for a flex halfshare and all the maintenance since until this year. I have no intent of paying again. Marjorie

We have owned our unit since 2010. We live outside the us and use the points exchange with RCI. We have never received any information about the lawsuit, or a buy back option. Do you know where we find this information for buyback options? We are happy to return our unit, but if not will continue to use the exchange points as secondary option. The maintenence is crazy on this place.

I have not followed the information on the lawsuit involving the Manhattan Club, but I know this timeshare is a ripoff. I have been an owner since 2003 and the yearly cost is ridiculous. I would very much like to get rid of this timeshare but have no idea how to go about it. Can someone advise me how to begin this process. If I have to just turn it back to the company I will do so, but I no longer want to continue paying for this. Thank you.

Quit paying the fees for starters. Then they may contact you for a buyback. Since they admitted to bait and switch, and made a $5-6 million settlement, which is basically taking a responsibility for a wrong doing, they aren't likely to send creditors after you, but they may threaten. If they do, tell the creditors that a faulty contract was made and direct them to the NYAG's website and link to the situation and settlement. I read of several owners who handed it this way over the years. I sold one timeshare back for $100 in 2014 and another a couple of years ago, both inherited (nightmare). There was no way I was joining the Zimmerman effort. I knew if he got anything, it would be years and cost a lot of money. Things also depend on what kind of contract you have. That is my advice.

Just stop paying your maintenance fees and tell them you want to give it back. They’ll do nothing until you stop paying the fees. I had no issues. Got my bill, told them I’m not paying to take it back and shortly after received the paperwork to sign it over. Best decision I made.

It is April 2023. I have been an owner since 1999. I stopped going and paying several yrs ago. I wrote several letters and received several phone calls and $100 offer payouts. I always made counter offers but then without their responce rejecting my counter, it seemingly went to collection. I ignored that too since my credit is impeccable, I figured we could explain it away especially since all the lawsuits and that I have in good faith negotiated to their offer with the customary counter-offer which is still on the table. I am no longer using the unit, they rent my unit and receive 100% of the revenues. At this point, I simply hold a deed. Anyway, I was getting a bit nervous, I don't want this to be a nightmare for my children....Long story ..but today I received a voice mail from TMC that said they want to make an offer. Hummm intriguing. I haven't called back yet. I am looking for $1k. I will keep you posted after I make the call. I will require any offer to in writing before accepting. I hope this is a new more reasonable offer and not the same stale $100 bs. Stay tuned!
