Manhattan Club Lawsuit
The suit is ongoing and continues its slow pace but seems to approaching some direction. Have stressed numerous times this is a gamble of $1995 to be included as a claimant vs giving up and getting nothing. Other than selling out your interest for $100 your total investment is gone already

I’m not at timeshare owner. I’m just considering renting from a Manhattan club timeshare owner. Anything wrong with that? There seems to be multiple offers on this page. Does Redweek organise everything? Please let me know your thoughts before I book…. Thanks Anja

I don't understand about the lawsuit. I was under the impression that it was dismissed. I stopped paying but was always contacted by the Manhattan club for the money. I was offered the $100 but then they wanted 2000$ to transfer the deed. I refused and they dropped the money if I just sign it back to them. After the lawsuit was thrown out I just figured that once again big money wins out and take my losses but before I signed anything I looked all over the internet to see if that is the best thing and found this about this attorney and you have to pay to be a.part of a "class action suit". Is this just another scam or does he really have a plan?

Actually the suit was not dismissed. Here is the latest correspondence I received from Mr Zimmerman:
We are still waiting for the Court to rule on the motions to dismiss that defendants filed last November and that have been fully briefed since January of this year.
We’ll let you know as soon as the Court issues its ruling.

I’ve tried posting a response to this a few times now but nothing’s shown up…. not sure why. Booking through Red Week is fine — we do that when renting time shares. I recommend you select someone who Red Week indicates is “verified”.

I spoke to Jean Marc Zimmerman Friday to get an update on the status of our lawsuit against TMC. Contrary to several erroneous postings I have seen, our suit is very much alive. About a year ago, TMC motioned for our suit to be dismissed and Zimmerman responded with a forceful rebuttal. We are waiting on the judges decision on the motion to dismiss to see if our case can go forward to trial. Jean Marc asked for a conference with the court to discuss the delay, which was held in February. The court apologized for the delay and told him a decision was forthcoming. Jean Marc is willing to wait another 4 months for the judge's decision and then might have to take further action to get a decision rendered. JM says this kind of delay is NOT UNUSUAL these days ( a year or more) The wheels of justice grind slowly, but at least they are still grinding! Bob B.

They must be desperate to get owners out - I imagine they can't do anything with the building until they are sole owners. Yet, they are unwilling to make owners whole and at a minimum pay back the purchase price and annual fees/costs. In the meantime they are renting out the rooms and keeping all the rental income. Until owners are made whole, there is no legitimate offer on the table.

I would say that's a great way. It helps owners who can't use their nights before the end of their contract year. I don't think the Manhattan Club benefits.

I converted my TMC ownership to RCI points years ago. I use the pints to stay at TMC and go elsewhere using points. I bought in 2005 and my fees have gone up but do have other timeshares elsewhere. I still love visiting NYC and staying at TMC.. I just must book way in advance… unlike when we first bought.

You referenced a conference meeting Zimmerman had with the court in February and Zimmerman's willingness to wait four months for the court's decision, which means June 2023.
Your April information was helpful as an update up to that time.

Robert A., Sorry to report there is no news to report. I think JM indicated he was willing to wait until the end of the summer before taking any steps to try to get a decision on TMC’s motion to dismiss. I don’t know what he can do to get a recalcitrant judge to act. He has to tread lightly. Bob B.
