We lost an appeal to the Second Circuit of a dismissal of our Federal RICO case last month. We have now updated our complaint and filed suit in New York County Supreme Court (state court) for breach of contract, tort, etc. The complaint has not yet been served, and we see strategic advantage to maintaining the complaint in a low-profile status at this time. We would appreciate it if you would not publicize this message. In the meantime, we have reached out to the Eichers and Hilton/BlueGreen to open settlement discussions. Neither effort has advanced, but discussion with counsel for Hilton/BlueGreen are ongoing. If discissions fail to advance, we will serve the Complaint and proceed with the litigation. Because it alerts the opposition. And they are waiting for Hilton/Bluegreen drama to play out.

EXACTLY - this should NOT have been posted -you listen to Counsel representing you - why did you not do that? Don't you realize that the opposing side monitors sites just like this one????

It has been widely speculated for many years that TMC monitors this thread. Good job Rachelle. Appreciate your input. You might want to circle back with Steve and let him know what you've done. Yes, this was a sarcastic response, but I'm not kidding about letting Steve know.

So looking fro some advice here. My dad passed away last year and just got a call from Manhattan Club looking for $3900 maintenance fees. No one has used the place since 2022. As you all know impossible to book etc,,, I asked about turning in the deed they said that is no longer an option and she cant talk to me until I pay. I am tempted to just ignore them but they have said it will go to collections etc.. Has anyone just ignored them and if so what did they actually do? I don't want to ruin my mothers credit or have liens against her but I don't want to shell out 3900 for a week we will never use. Any advice will be great the lady on phone said I only have 1 week to make a decision before fines and penalties start.
