Hello August, I admit that TMC lied, misrepresented themselves and are a bunch of thieves. But, the $100. buy-back (gift back ) is real. I completed my buy-back from the MC about 8 months ago and did receive the $100. I was 2-3 years behind on my maintenance fees and that was all forgiven as part of the buy back. In fact, it is my contention that if you continue to pay all your maintenance fees, MC doesn't have an urgency to do a buy back with you, but will instead want to place you on a wait-list for that. They really don't want to rid themselves of members that are paying in full, that is income for them. But, the dead-beat accounts, if you will, are more than likely to be approached. I also completed two other buy-backs with M/C about 5-6 years prior, after being on a wait list for years. I purchased my first M/C timeshare in 1996 and two others down the road. As M/F skyrocketed to nearly $10,000. per year for the three of them, I started to look at different exit strategies. It took awhile, but once the last one was completed, I feel like the noose was removed from my neck. I admit, this may not be best for everyone, but I do think it was best for me and my situation. It feels like a new lease on life. I still wish the best for those that are hanging in there and surely hope that someday they will reap the possible benefits of the lawsuit. I just couldn't wait and cut my losses along the way. I hope that helps.

Hi Cliff,

I realize that everyone has a different story to tell but to be raked over the coals, be taken advantage of and then give in to their demands is not the way I play. I’m furious with MC to the point that I will go thousands in back payments to see this thru. It’s become more principal to me now. I guarantee every $100 they send out to owners puts a damn smile on their faces as they are probably thinking that they hooked another sucker and I will not be a just another notch on their belt!!

I agree with you 100% - if you can weather the storm and continue paying the outrageous maintenance fees, consider doing that but also join the Zimmerman lawsuit. Maybe, eventually, there will be light at the end of the tunnel.

it's important to keep in contact with zimmerman. i hope his site is up and running very soon. our trust in his legal skills and connections can bolster his and his legal associates' strength and energy in his court proceedings versus any pending frauds attempting to alter our financial lives.

we must count on his legal strategies to prevail.

Hi Gary P., I certainly respect your desire to see this thru, even if it means spending thousands of dollars more to get there. Not everyone has thousands of dollars to see it thru like yourself and others. My point is that everyone needs to decide for themselves what is best for them and their own situation. If that works for you, that is great! But the line " give in to their demands is not the way I play" is a bit over the top. Manhattan Club did not "demand" that I take the buy-back and receive the $100., I chose to accept that with my own free will to avoid having to come up with any more maintenance fees. I, of course hope that Zimmerman is able to deliver and the courts will have a favorable determination for all of you that have so painfully hung in there for all this time that has passed and more time in waiting longer. You all deserve a positive outcome. I'm not as sure as yourself that is going to happen, especially if you think you are going to get your investment back. I've always enjoyed the Manhattan Club and continue to stay there, but with my RCI points, at a fraction of the cost of what my maintenance fees were. It just makes more sense for me. Why keep my membership and pay $3300. for a week, when it costs me about $1000. a week by using my RCI points- at a cost per point basis. Once again, best of luck to everyone that has been shafted by M/C and are willing to see it thru.

the only issue is that he's a real estate magnate who would probably benefit financially from your kindness.

happy belated holiday greetings to all observers, and goodwill to others with alternative beliefs.

with the holidays over, but the coronavirus still attacking us, we are all entitled to stress relief: a time to sit back, take a deep breath and release some of the unhealthy fumes.

on the other hand, rest assured that our dreaded foes at TMC are working hard to defeat and continue to defraud us, even during this stressful time for us all. that said, we shouldn't allow them another foot in the door of legal retribution for us owners. our legal efforts are certainly secondary to defeating the coronavirus pandemic, to be sure! however, the reality is that of both problem issues continue to exist. (an owner source said that TMC is thinking about amending reservation regulations, even though these owners had issues preventing them from using their paid-for reservation time which was affected by the coronavirus. does the adage, "have a heart." have any meaning?)

ladies and gentlemen, i am suggesting that we not let our guards down during these ultra-stressful times. yes, many of us have much more important and health-related concerns to contend with.

however, those of us who are more fortunate and perhaps less stressed, can possibly take up the slack and continue to work toward legal victory for ourselves and for our less fortunate owner brothers and sisters. we can't let TMC continue to haunt us and cause additional stress and trauma in our lives as TMC owners.

I did the same, wrote a letter outlining similar sentiments as Chris. I was supposed to use my penthouse for a week starting April 15th. I was told that they were looking into the situation and keeping a spread sheet of owners who I assume have also inquired, but at this point it was business as usual. I either use the penthouse by May 10th, the end of my contract time or lose it. Obviously not possible as I would be risking my life. The same week I got this response they sent an invoice due July 1 in the amount of almost $4,000 for next year’s maintenance fees. Did you all receive the most recent letter from Joshua Wirshaba, the manager of TMC? Stating that while the club has had to make adjustments regarding the Covid situation, they are still open for businesses.

I would expect more owners to now discontinue payments after realizing how the Manhattan Club reacted during this crisis.

hello again, fellow owners:

thanks for the responses to what i consider to be your support for my request (for a reservation time extension) to TMC during this time of coronavirus pandemic life and death issue.

TMC's response to my reasonable request for a reservation time extension will show, in part, the essence and extent of what their hopefully humane and customer-centered attitude is. this extension of time should be offered to all owners that fall within a similar timeframe as mine.

we don't need spins on why TMC should not honor my request and extending it to others in similar situations. spinning is for skaters and gymnasts, not for people facing potentially life-threatening circumstances. the reservation extension time should, as coronavirus circumstances prevail, be extended, as appropriate, even beyond the time i requested.

my plea (request) should not fall on deaf ears and should be honored in a positive manner, as TMC has always said, to provide owners with pleasurable and customer-centered accommodations. pandemic issues are central to accommodate all involved. if new york governance assistance is required to satisfy my reasonable request, that will be considered.

TMC, step up to the plate with humanity and goodwill.

what in hell does this translate to?:

after all is said and done and "as we move past this crisis", the coronavirus will have been conquered, and we will have to USE IT (OUR RESERVATION TIME) OR LOSE IT. they are lower than scum

TMC principals' main goal in life is to build wealth exponentially without regard to international pandemics, fairness, legal or any other human or humane quality.

TMC might heed directions and admonitions by new york offices of governance concerning the current pandemic life and death issues and the strong requirement for social distancing and gathering currently in place.

waiting until ".....we move past this challenging time." is too late. we need and deserve a positive response now. no offering plan provisions should come into play at this life and death challenging time. if new york governance needs to be summoned, this might help us all to gain a semblance of fairness and humanity from TMC. this will be a major consideration that will be shared with all owners at TMC.

We joined the Zimmerman lawsuit over a year and half ago. During that time we have not received a single direct communication from Zimmerman. Very disappointing. We have a decision to make: do we pay the Manhattan Club annual fees that are due soon, or do we give up on Zimmerman and stop paying our annual maintenance fees? Any suggestions? We want to fight TMC, but in this vacuum of communication from Zimmerman we are wondering why bother. Why not, instead, take the proven way out and stop paying our fees and wait for TMC to buy us out at $100. Every year we wait it’s another $3,000 in fees. At some point these fees will far surpass what we ever hope to recover from a lawsuit. By pulling the plug on paying further TMC fees we have the prospect of not being bled dry over the years waiting for Zimmerman. Zimmerman - are you listening. Can you communicate with us? Why should we care?

i joined attny zimmerman's lawsuit and have had communication with him. i too am not satisfied with the frequency of contacts. (keep in mind that is an extremely traumatic period in our lifetime!) on the other hand, life goes on. i suggest considering communicating your comments made here directly with jean-marc zimmerman (and not on redweek). he is certainly not unreasonable and perhaps needs some prodding to give you some of the results you seek from your association with his legal organization. just indicate here that you connected with him, but give no details here of the contents of your contact with him. TMC constantly monitors redweek.com for more legal ammunition to use against us.
