TerriC - once again you're not really reading. So here's a response to your latest post: 1) You mention that I've got the date listed as July for trial, not August. Check when that post was written. In 2011 we were due to go to trial in July. SLVC filed for Chapter 11 Bankruptcy on the first day of the trial so it never really got started. A year later (and SLVC is on it's 3rd law firm since the bankruptcy filing), we now go to trial on August 20th. Oh, by the way, the bankruptcy was dismissed by the Federal Court since SLVC didn't provide necessary paperwork and just generally didn't seem to really wat to take it seriously, even though they are the ones that filed. We believe it was done mostly to stop our lawsuit. That, obviously, failed. 2) AFTSLVC is not a full-time organization with full-time employees. We all have real jobs and rel lives so I'm so sorry we aren't updating our website on your schedule. There is still information to be decided by the court from that hearing - we thought we'd wait until ALL the information is available. 3) If you would read the Minutes section on the court website for the hearing you'd actually see that the chance to have the Summary Judgment adjuticated (heard) was granted. It had previously been turned down by the court and SLVC had been told they needed to rewrite it before the court would look at it. The minutes say " THE COURTS TENTATIVE RULING BECOMES THE ORDER OF THE COURT ON THE MOTION EXCEPT FOR ISSUE 1-IF ASFT DOES NOT AMEND THE COMPLAINT. DEFENSE COUNSEL MR. HUFNAGEL TO PREPARE ORDER AFTER HEARING AND SUBMIT TO COUNSEL FOR APPR. COUNSEL TO APPROVE ". If you had a copy of the tentative ruling (which either you don't o you don't want to admit to) you'd see that many of our causes of action are still in play. The court ruled in SLVC's favor on a few issues and denied others. Add to that that the Summary Judgment didn't include all of our causes of action in the first place and we're still going quite strong. We will post the official order on our webste once it has been signed and approved so you can read for yourself what happened. 4) We are all hiding? Is that why SLVC has sued us in a cross-complaint INDIVIDUALLY? They didn't just pull names out of a hat or make them up when they filed the cross-complaint. All that information is also available on the court website. And, FYI, the part of the Summary Judgment saying that AFTSLVC has no right to sue as an organization was denied by the court. We go forward as AFTSLVC just like we always have. When our contracts are all voided by a Breech Of Contract ruling you'll see our names again. 5) You might want to check the court website for a case regarding Thomas Pinero also. He filed a suit agains SLVC for some (but not all) of the same items we are claiming before our suit got started. the actual trial was in April but the ruling just went up yesterday - he won "JUDGMENT WILL SHOW PLAINTIFF PREVAILING ON HIS BREACH OF IMPLIED COVENANT OF GOOD FAITH AND FAIR DEALING". SLVC was given nothing in their ross-complaint against him (which matched the cross-complaints against us pretty much exactly). Clearly forshadowing for our August trial.
