I MUST AGREE!!! We bought in 1999 because of their promise of low maintenance fees. They not only added 10% every year, but now Levy and Taxes too. Also, they want us to pay for damages from 2004-2006 from an act of GOD!!! They sent me a letter saying our Gift Certificate (yeah, the one we are supposed to be able to pass on to our heirs and get $14,000 in 3 years from now) has been cancelled due to my non-payment of special assessment fees that supposedly their government said they can charge!!!! What does "no provision for rescission" means? We should band together in a collective lawsuit. They ARE robbing us!
The awful truth is that special assessments are part and parcel of timeshare ownership, just as rising maintenance fees, however the salespeople don't tell you about such during presentations. When a resort does not have the proper reserves in place and a natural disaster hits or there are severe maintenance issues within the resort then the HOA or developer begins the special assessment process charging owners for such.
If a special assessment is not paid then the ownership can go into default.
Also, anything they told you that is not in the written contract means absolutely nothing (ie: the maintenance fees will never go up). It's what's in the written contract that counts in a court of law, not all the lies and hogwash they told you in the presentation.
