I have received the restitution payment as well for 4 weeks that I own. I am wondering if anyone that has paid Zimmerman feels as though he is able to do anything and if he is communicating to those who have joined the process?. I can no longer pay on 4 weeks. I would love to stop paying on 2 of them but I dont want to hurt my credit. Anyone have advice in this blog? Miriam

I received a check Jan. 21 for $101.22 as my share of the second restitution payment from the Manhattan Club for maintenance payment made in 2018. I’m wondering about the first restitution also.

I received a check for $202.44 as well. I spoke with John Zimmerman and the wheels are turning however it’s going to take some time. The lawyers defending the past owners of the Manhattan Club have deep pockets and are using every type of tactic to stall the proceedings. John Zimmerman feels that we have a case and he will win some sort of restitution for all that have joined the class action suit.

I also received "2nd" check and emailed the signer of the letter on this issue.He replied there were different criteria for the first check vs the 2nd,and for details,he referred me to the settlement doc,which he attached to his reply to me. Although small,I would think anyone not cashing the check as a protest is only giving the money back to either the club or NYS,so don't see how this makes anyone feel better.

My husband received a check for $86.60 from the NY Better Business Bureau. His name is first on the deed so he got the big bucks. It said it was the second payment in the settlement. We never received the first! Our fees are all paid up-to-date. We have no clue why we received this!

I spoke to John Zimmerman and he said to cash it but write in the memo that this does not give up my right to sue for further restitution.

We also received a check for $173, the amount for a one bedroom suite, I presume. I am not clear as to what this is for. We have paid our maintenance fee for 2020 (they happily charged my credit card on file without even advising me...I discovered this only when I received my credit card statement!). Can anyone tell me that this amount only represents “overpayment” of 2018 maintenance fee and does not affect our “ownership” rights, whatever they may be? Thank you!

I got the exact same check and message, from Louis m Solomon chief of enforcement, real estate finance bureau. The envelope says better business bureau. Are you cashing yours? I also did not get a first check and I'm kind of confused about what to do. Nancy Wilson ñ

I also received a check of $173.21 that stated "In accordance with the Assurance of Discontinuance dated August 14, 2017, the New York State Office of the Attorney General is pleased to enclose your share of the second restitution payment from the settlement with the Manhattan Club and its Principals. This amount reflects payment of your pro rata share of all maintenance payment made in 2018". The letter was signed by Mr. Louis M. Solomon. The check came from the Better Business Bureau of NY.

I am confused because I thought the lawsuit was still handling maintenance fees between 2011 to 2014. I am not sure why the letter stated "maintenance payment made in 2018".

I have been a time share owner of the Manhattan Club in good standing for over 10 years. I paid the timeshare in full and was promised that if I decide to sell it - The Manhattan Club will buy it back.

They will buy it back for $100. I cashed my check however I also joined the John Zimmerman lawsuit last year hoping to get some restitution for over payment of maintenance fees over the years . I’ve been a time share owner of the Manhattan club since 2004

I live and work in Asia and I just received a check of 147.23 dated Jan 17, 2020 this afternoon. Attached is a letter from the State Of New York Office of The Attorney General signed by Louis M Solomon which stated "In accordance with the Assurance of Discontinuance dated August 14, 2017......" which is exactly the same as Evelyn M's and others.

Ridiculous !! I have been an owner for 20 years and paid every single cent without fail in the past. Enough is enough and I am not going to pay anything in 2020 !! What do most of you do with the check ??

Joanney...my situation same as yours except I live locally. Stopped paying this year, cashed the check $143+ and signed give back papers. Big weight off shoulders.

I sent an e-mail to request the survey and never received it! We want out! On line, you can make a reservation for a manhattan club room for $134.00 per night! Our most recent maintenance fee was $3200.00 and change! Please advise.

The various restitution checks from the attorney general should not be confused with any buyback offer. The restitution check is for settlement regarding a specific year's maintenance fee. If you are relinquishing your week of usage for the $100 offer, it will be accompanied by a lot of paperwork that has to be notarized, so it will be obvious.
