What about Mr. Zimmerman, Chris? Isn't he doing anything?
chrisv126 wrote:it appears that so many of the "GIVE BACK" issues are additionally screwing owners by taking an extraordinary amount of time, piles of paperwork while owners are still dutifully paying maintenance, although they prefer not using their TMC time. some, like mara f (above), also paid her attorney's fee of $1250 plus $3000+ maintenance. all she'll finally get (after waiting a lengthy time) is MAYBE $100 FROM TMC and she will have given away her initial investment. this is criminally fraudulent on the part of TMC (what else is new?)!! TMC/EICHNER/BLUEGREEN appear to be getting away legally with committing criminal fraud. are there no laws or legislation to control this form of white-collar criminal activity specifically within the timeshare industry?TMC/BLUEGREEN are getting away with criminal fraud and no one is doing anything about it. yes, some have retained an attorney, but, we're told the legal process against these criminals takes much time. the former nysag did nothing that comes close to a fair and equitable settlement. we owners are no better off now than we were before former nysag litigated our case. he SETTLED for no more than an inadequate legal penalty. in fact, criminal fraud was admitted by the plaintiffs, TMC/EICHNER, but the end outcome of the litigation was a mere paltry SETTLEMENT, a senseless, unfair penalty to say the least.
where do we go from here to achieve legal justice against this criminal activity?
can anyone offer a viable solution to this continuing fraud (e.g., the continuation of the exponentially exorbitant maintenance fees?)

Hi Antonella, The attorney I used has given me permission to give you her contact information but I would rather give it to you by email. Also, it probably would be a good idea to check with Lynne O'Donnell or Danielle in Financial Services to see what is happening with buy-backs now.

Thank you so much

Update on Tucker v. TMC:
We are pleased to report that last Wednesday, February 19, 2020, the New York County Supreme Court granted our Order to Show Cause which has the effect of temporarily enjoining subpoenas that TMC recently served on my colleague Steve Hoffberg and myself to obtain documents from our files, pertaining to TMC members we represent other than Mr. Tucker despite the fact that Mr. Tucker does not know what other TMC members we represent and his legal action against TMC is distinct from our other representations. TMC's subpoenas also sought to depose both Steve and myself. Jean-Marc Zimmerman Zimmerman Law Group 233 Watchung Fork Westfield, NJ 07090 E: jmz@zimllp.com T: (908) 768-6408 F: (908) 935-0751

Update On New Case Soon to Be Filed Against TMC
We are in the process of finalizing the complaint we will soon be filing in federal court on behalf of those TMC members who have retained us, against TMC's management and its former and current Sponsors for their wrongful conduct in operating TMC. There remains an opportunity for other members to join us. We will be contacting our clients over the next month to confirm certain information regarding their TMC timeshare purchase, and their corresponding TMC membership experience. We will also soon provide those TMC members who have retained us with access to a website to get updates about the soon to be filed suit.

Hi I have just found this website & forum for the Manhatton Club. My wife & I got sucked into buying a unit over 10 years ago & have never used it. I have complained to them that the ongoing maintenance fees were more than what I could rent an apartment for via on line booking. We are Australian and have never been so disappointed and distressed over a purchase. Living in Australia we do not hear any of the legal lawsuits etc that have been going on. I have recently lost my employment and cannot pay the annual maintenance fees and have now been hit with Late charges etc. Could anybody advise me how to dispose of our unit, or can you just give it back at no charge Regards and thanks for any advice or help Glenn Baggs

hello glennb181,
losing your employment is so unfortunate! even without that burden, the manhattan club developers have defrauded all owners with, among other criminal sales schemes, excessive, exponentially exorbitant maintenance fees (which we were told by the sales personnel would "rise slightly" over years of ownership.) i started with a $600 per year maintenance fee per week owned. it's now close to $3,600, not quite noted as a "slight" raise over the years. the manhattan club corporate management, headed by ian bruce eichner has admitted to criminal fraud in court vs the former new york state attorney general, and been fined $6,000,000 for this fraud and prohibited from doing any further timeshare business. this is what the former new york state attorney general "SETTLED" for, which hasn't helped any defrauded owners such as you and me.
to your point: this is NOT my recommendation but, for only your consideration, which offers you a chance to dispose of your manhattan club obligation.
the manhattan club has arranged for owners to RELINQUISH OWNERSHIP if they choose (another option is to keep paying maintenance and keep in good standing with your ownership.) keep in mind that this relinquish option means that you lose completely your initial purchase investment, a total criminal disgrace on the part of the manhattan club. the manhattan club does NOT BUY BACK, JUST OFFERS RELINQUISHMENT. the sales department had told us that purchasing in the manhattan club would be an excellent investment opportunity for the possibility of selling your share in the future. that's one of the biggest fallacies of all. owners can't even get more than $100 for resale.
for accurate information on the method of RELINQUISHING OWNERSHIP, call the manhattan club FINANCIAL SERVICES OFFICE at the following number and indicate your intention to relinquish your ownership:

sincere wishes for good luck in improving your current unfortunate financial situation!!
