Manhattan Club Lawsuit
Another way of possible getting your money back is joining the Zimmerman lawsuit. I joined about 1 year ago and its starting to gain traction. I am also upset to the fact that I bought value but the only value I made is the exorbitant fees that I'm paying each year. The other sticking point is the value of my time share is not even worth $100. I'm really upset over this and I'm not going to take it anymore!! Gary J Paccagnini owner since 2004
Update On New Case Soon to Be Filed Against TMC
We are in the process of finalizing the complaint we will soon be filing in federal court on behalf of those TMC members who have retained us, against TMC's management and its former and current Sponsors for their wrongful conduct in operating TMC. There remains an opportunity for other members to join us. We will be contacting our clients over the next month to confirm certain information regarding their TMC timeshare purchase, and their corresponding TMC membership experience. We will also soon provide those TMC members who have retained us with access to a website to get updates about the soon to be filed suit.

Thanks Chris. I think I may go with the RELINQUISH as we live in Australia and it is easier and cheaper for us to book accommodation on line. It is even cheaper to book the Manhatton Club on line without being an owner. I have been looking to see if they have an email address, but cannot seem to find one, would you know if they do have an email address?

it's literally criminal that you must lose your initial investment to use the RELINQUISHMENT ALTERNATIVE. TMC should pay you the full nyc real estate value of the week (s) you own, less any maintenance fees that are in arrears.
however, you must do what you think is best in your current financial situation. (an alternative for your consideration, if this works for you, is to join attorney jean-mark zimmerman's lawsuit...his strategy and contact information are within the pages of this forum.)

i totally agree with you and have also joined attorney zimmerman's suit several months ago. unfortunately, as with glenn, some of us within our own circumstances, cannot do this without an extra financial burden.
TMC/IAN BRUCE EICHNER has affected owners' financial lives by his defrauding so many of us. i look forward to the day of legal reckoning to be bestowed on TMC by attorney zimmerman's winning the suit brought against TMC/EICHNER, et al.

Here is an email for Lynne O'Donnell in financial services...she has been handling by backs: LynneO@tmcny.com. Since you live in Australia you could consider just stop paying them. It would cost them a lot to come after you and since they were found to be fraudulent by the NYAG...any case they would bring against you wouldn't have much of a leg to stand on.

Can you or anyone on this site please tell me the goals of the Zimmerman action? I have 4 weeks and I’m getting ready to relinquish 2 of them to reduce the hardship of the association dues. It seems to me that this is going to be a long and arduous attempt to reinstate the true value of our ownership especially when the value now is at 0.

I'd also like to give back my timeshare. I just paid $3,244 for taxes and maintenance. Ridiculous. I just want to get out. Any thoughts?

your statement that, "especially when the value now is at 0" is both true and false. the value is $000 for TMC owners, but exponentially higher for TMC/BLUEGREEN.
we are discussing the value of a new york city near-luxury accommodation; this cannot possibly be worth $000. this artificial worth is one created by TMC/BLUEGREEN. they realize the financial dilemma that some owners face, and they are taking full and criminally greedy, fraudulent advantage of this situation.
think of it: we relinquish our deed to these thieves. they now have property inventory to sell as they see fit: either as a hotel or as another timeshare to sell at CURRENT MARKET VALUE...e.g. hotel----at least $3-500+ per night; or as a timeshare, at least $50-70.000 per week. does this match the amount of $000 ascribed to the value of TMC owners' initial investment? the answer is a resounding NO.

Hi. I just enquired as well to the Manhatton Club on Relinquishment of my timeshare & was advised that they can put me on a list that may take several years for the process to eventuate and in the meantime I am still considered as an owner I would have to keep paying the fees etc. Since Oct 2019 I became unemployed and no longer have an income and therefore I am unable to pay their ongoing fees and charges. Any advice would be greatly appreciated, or any contact details of whom to get in touch with would also be appreciated. I live in Australia and have only just become aware of the ongoing ownership battles with them. Glenn

My give back for $100 took from June of 2014 until recently (2020) when I received the check. Plus they don't send you paperwork or copies of what you signed. They say you have to go online to see that it's no longer in your name...So when you get your paperwork to sign, I highly advise you make your own copies so you have something in writing to show this transaction happened.
On another note, I guess it would be ridiculous for me to think I can reschedule my upcoming week at TMC in mid April because of the Corona Virus. Otherwise I lose $3700. I am going to try.

as i recall, you can cancel a reservation (i believe) 72 hours prior to the beginning of the reservation. notwithstanding that "rule" and under the dire circumstances surrounding the coronavirus, demand that they let you cancel or postpone your reservation. in the worst scenario for you, threaten them saying you will report them to the CDC AND/OR THE DEPT OF HEALTH AND HUMAN SERVICES.
