Hi Glenn. I’m also based in Australia and had the same issue. You need to send the cheque back with a letter stating that you require a 6 month one to have any chance of getting it banked in time as banks here need 6-8 weeks to clear an international cheque. I had to do this previously and took about 4 months to get a new one.

The Manhattan Club has released their budget for 2021. As expected there is another increase. The increases range between 1.8% and 2.2% with a $53 - $74 dollar increase over last year. This does not include the real estate taxes.$13,500,000 is allotted for bad debt. Another interesting side note: Joshua A Wirshba is still listed as the General Manager.

"Joshua A Wirshba is still listed as the General Manager."-----sadly interesting and NOT a good omen. it may also border on the illegal or perhaps definitely be illegal according to the interpretation of eric schneiderman's, nysag, SETTLEMENT.

I agree Chris it is unbelievable (or maybe it’s not) that this individual is still the General Manager. It will be very interesting to see what BlueGreen does as far as maintenance fees, top management etc. when they finally take complete control which I believe is in July or August.

maybe it's wishful thinking, but it's possible that TMC's legal movers and shakers are running out of steam. they seem to be drawing at non-existing straws. are we wearing them down?--- a mysteriously good thought to consider. attorney zimmerman and his team seem to be emitting some positive vibes.

I take note from recently received 2021 budget(Schedule B and related footnotes),that in Time Share Assoc " labor" budget of $22 million,it includes "salary and benefits"of "general manager",along 4 "admin",along with all the other employees.
There is ALSO $7.2 million "Management fees"from NY Urban,which I believe is sponsor,and note says they've agreed to "cap" at this amount. I guess I always assumed GM was part of "management fee",but apparently not,which makes larger the question of what services are provided for this $7.2 million?. It also answered question as to why the GM stays/will stay,he is "our"employee,not the sponsor,who is supposedly to leave the picture under AG settlement. As AG settlement I thought also says sponsor gives up control of board, maybe this will/can change. Also,whether Blue Green will try to retain the $7 million fee is an additional issue.
As an additional aside,I have always found it interesting that they have always just given us this -one year of the new budget.In many many years of financial management,I've always seen such info as a comparison to prior year actual,and most time how the prior year compared to prior year budget-so you can see how management did vs budget.This is necessary I think to better understand and flag concerns in a new budget.I queried this a number of years ago-I was told they didn't think owners wanted this(?)

Re: Management fee. Isn’t this the fee that used to be $6 million to Urban, which was really Eichner et al? Should this not still be happening in 2021. I thought Eichner had to stop managing by summer 2020, 3 years after the AG settlement. Does Eichner control Urban? The entire organization is such a complicated web.

in my opinion and distant observation, eichner and cohorts do what they want, when they want. there appears to a clandestine quality about their actions at/with TMC and it doesn't seem to be within the realm of legality. how do we combat this questionable scenario? are they getting support from outside sources? these questions and scenarios should be investigated, especially in light of the former new york state attorney general, eric schneiderman's unsatisfactory SETTLEMENT of his court case against TMC/EICHNER. is TMC/EICHNER following completely the directions of the court SETTLEMENT? has there been any overt monitoring of this issue?
these are the legal problems that require full disclosure and explanation, including the takeover by BLUEGREEN, which complicates this matter even further. forceful and strong legal maneuvers should be implemented immediately by our attorney, mr zimmerman and the new york attorney general, leticia james (or both within their separate capacities) to determine if the law is being precisely adhered to or not by TMC. this should then be followed up with appropriate legal penalties per the legal non- adherence findings if determined as such.
we owners are continuously being defrauded by TMC, especially with, e.g., the ongoing increases in our already corruptly exorbitantly raised maintenance fees. how long should we remain the victims of this long-standing scam? how long should TMC be allowed to continue to defraud us and create poor financial health for so many owners because of this continuous fraud and scam?
.....so many unanswered questions and currently no immediate relief in sight.....court proceedings generally take much time. so far, there have been court proceedings concerning TMC/EICHNER from 2014, and more probably even before that. so much legal time has passed and still many owners have found themselves in dire financial straits due to TMC's fraudulent lies and actions since the moment of the lies and scams at the sale/ point-of-purchase to the present. even TMC's generous buy-back offer (sarcasm intended) has left financial holes in owners' pockets, while the TMC principals' pockets are being filled with our money.
the MEGA TMC ISSUES HAVE LASTED LONG ENOUGH. WE NEED ADEQUATE ANSWERS AND RELIEF ...................................NOW. to this end, proactive ideas and recommendations from as many of us owners as possible are needed. include approaches helpful to attorney zimmerman, and the honorable leticia James (nysag) as appropriate.

We all need to figure a way to get together as a group and state our case. I can not afford $3900 a year especially after this financial crisis that hit us all. Are there any suggestions or do wait for Jean Zimmerman which may take a few more years. Time has run out for me and my patience has run thin!!

if we TMC owners had a list of contact information of all TMC owners, it's possible we that could "...get together as a group and state..." and legally pursue..." our case..." efforts to obtain and use this list judiciously have been made, but the conclusions of these efforts have not been made available to date. ENOUGH WAITING. WE NEED IMMEDIATE ACTION TO BE ADEQUATELY, LEGALLY AND EQUITABLY COMPENSATED FOR THE TMC FRAUDS AND SCAMS against all owners. awaiting the results of attorney zimmerman's efforts is one possibility. another might be filing an additional complaint with the current new york state attorney general, letitia james, if that's within the legal boundaries of our efforts. the current coronavirus health and financial crises are being exacerbated exponentially by further legal delays concerning our relationship with TMC. owners need substantial financial RELIEF NOW, and certainly NOT in the form of totally inadequate checks disbursed via the BETTER BUSINESS BUREAU or by the nonsensical BUY-BACK offer made by TMC. our nyc property is currently worth a great deal more than the value (or non-value) of the BUY-BACK. owners' stance and determination must be solid, strong and within defined time limits. ENOUGH WAITING.

I received a Judgment on my case. The Judge dismissed my case against TMC and their counterclaim against me. TMC sued me for back maintenance payments. I am appealing the Judge's decision. With the virus crisis, the courts are essentially closed for everything but emergency legal matters.
I am readying my appeal documents and will be first in line when the Courts reopen.

irene, your dismissed court case vs TMC, leads to much wonderment: is there a possibility that TMC has any influence over court decisions and procedures? maybe that thought is far-fetched, but it seems not to be an impossibility.
we TMC owners are hanging in a legal and one-sided imbalance (in favor of TMC) and unless we present a 14 to 18,000-owner united front (with the help of the owners' contact list) we will continue to be the defrauded losers.

We are ready to join the suit but do not know how many owners have joined the suit. My husband has emailed Jean Zimmerman and we are awaiting a response. Can someone compile a list of email addresses? I am not technologically savvy enough to do it or I would. If everyone on this blog would send their email addresses to one certain person perhaps a list can be made of owners? Just a suggestion. Thanks for the updates & information.
