The same here....plus with New York imposes a mandatory 14 days quarantine, ( for most of us) what are we going to do in NYC if we can get there? Lock ourself in the room?

I stopped joining this forum about 12 months ago. I am so sad to read that so many people are still complaining about the maintenance fees and looking to get reimbursed for time you have not used.It is not going to happen you bought into a time share and the rules are the rules.The attorney General for the State of New York investigated the owners complaints and the findings are on the website.when you stop paying maintenance charges you forfeit your right to complain as you are putting a severe burden on those of us who are members in good standing, a contract is a contract.Now you are paying a lawyer to get your money back ,its not going to happen.pay the maintenance charges and enjoy the BIG APPLE or walk away and stop whining.IT IS WHAT IT IS. We win some and we loose some.

A contract is a contract and TMC voided the contract when their sales people and management intentionally and willfully defrauded the owners by promising one bill of goods and delivering another. It's called bait and switch/in other words fraud and they were found guilty of this by the NYAG. The NYAG did nothing for the owners. I can't blame anyone for doing what they feel they need to do which reflects what is in their best interests. They deserve to do so. If that means stop paying fees, then so be it, but it's not fair to say that the owners who have been defrauded are creating a burden for those who chose to stay with the club and pay fees. TMC and their low life management, have been ripping owners off for a long time and continue to do so. They are the ones responsible for the extra burden you are paying in your fees.Covid is a rare and extenuating circumstance. You can't expect people to risk their lives to travel to NYC where there is nothing they can do there any way. Decent people and businesses make allowances. My husband and I had tickets on Canada Air to go to Europe in September and they gave us until December 2021 to use them. I have stopped paying, I accepted a long time ago that bad things happen to good people and I enjoyed the club for many years and I am not going to waste my precious life force on this anymore. I still legally own it, so let's see what happens. BTW, I inherited 2 timeshares, I was told I couldn't deny them by lawyers, 3 of them. I am not getting involved with another lawyer. I myself, would never have invested in a time share.

Please do not tell other owners to pay their maintenance fees. The contract is not a contract when it is broken and fraud is involved. If you choose to pay your maintenance fees that is your business. Also if you are so concerned about the burden of “members in good standing” paying additional fees then maybe you should direct your feelings to the Board of Directors and Manhattan Club management not owners that have been treated badly and taken advantage of for many years. Finally, unless you have some type of inside information that others don’t how can you say that the lawsuit will be unsuccessful? Time to get off your high horse..

I am in the same situation as u. My maintenance fees were about 4K this year and over the last 16 years watch them go up substantially. I am part of Zimmerman’s lawsuit and paid my 2021 Maintance fees hoping that he can get some sort of resolution. I also agree that this is probably my last year paying them however I’m a little bit nervous on what may happen. In all my 62 years I’ve always fulfilled any type of obligation or debt that i incurred however this feels different. I feel that I’ve been swindled and lied to that our investment would be worth much more than we paid and not to worry about increase in Maintance it will only be minimal. I agree with u about everyone stopping all at one time and blame Management of the Manhattan Club for their deceptive sales practice. Owner of a Penthouse Unit

Did Attorney Zimmerman indicate how long he expects the case to take? 2 years more or less? You mention the case is for reimbursement of purchase price and annual maintenance fees. I presume there is a difference if the purchase was from TMC or a time share owner on a resale.

I believe the case is solely for reimbursement of the purchase price from TMC. However, I strongly suggest you contact Zimmerman with that question. Regarding how long the case will take, I have no idea. Again, that is a question for Zimmerman.

PRESS RELEASE: Zimmerman Law Group and Hoffberg & Associates are pleased to announce that on August 30, 2020 they filed a lawsuit in federal court in Manhattan, on behalf of more than one hundred owners of timeshares at The Manhattan Club (“TMC”) located in New York City, against TMC’s former and current operators - and their agents and management, for longstanding and persistent wrongdoing in connection with both misrepresentations and deliberate omissions of material facts made during the sale of TMC timeshares, and abusive post-sale operational practices at TMC that continue today. Unfortunately, the investigation conducted by the NY State Attorney General of TMC’s former operator for such wrongful conduct resulted in a premature “Discontinuance” of the investigation of TMC in 2017, provided negligible financial compensation to TMC timeshare owners, and failed to stop the wrongdoing that continues unabated today. The federal lawsuit filed last week asserts breach of contract, tortious interference with contract, fraud, breach of fiduciary duty, and most significantly repeated, pervasive acts of fraud over many years that give rise to liability under the federal Racketeer Influenced and Corrupt Organizations Act (“RICO”). The lawsuit seeks redress for the high annual maintenance fees and abusive reservation policies,which together with other wrongdoing have collectively rendered Plaintiffs’ TMC timeshares financially worthless. Because I have not had a chance to read the entire complaint. Also, there were other members who stayed in contact with Attorney Zimmerman and knew what relief the lawsuit was seeking. I came in later and became a part of the group AFTER the arrangement for hiring him had been made. I totally applaud the efforts taken by the Zimmerman law firm and am much appreciative that one of our members had formed our group. Are you part of the group the firm represents?

I am not a part of the group but I would like to participate. I would like to be part of the buyback process if that is what's happening. I just lost 7 days and those greedy fat cats offered me no relief except spend more money. How do I join. I have emailed the Zimmerman organization and have not heard back. I left my email address and phone number with them.
