Manhattan Club Lawsuit

Good Morning, I am an owner as well who spent almost 4k for maintenance fees last year and got noting. I wish I had the money to join the lawsuit because I would sure like to get my money back. I hope this suit rolls over to other owners.

The lawsuit being handled by the Zimmerman Law Group is not a class action suit so only the owners who have paid their retainer and joined the lawsuit will be entitled to share in any settlement. I am a member of the group and have been pleased with the progress that has been made.

Yes, although at times it is true the wheels of justice grind slow. I am also a plaintiff with Zimmerman. I'm surprised by the "Options" offer from this scurrilous bunch.. Hoping the best outcome for all.

BTW I don't know if anyone else got the notice I received about the options for my timeshare...I might have been the only one. Who knows, but I still thought worthwhile to share.

To all owners: please do not be intimidated by any correspondence from the Manhattan Club concerning unpaid maintenance fees. Due to the criminal investigation of The Manhattan Club and the COVID-19 situation in New York City all owners have substantial evidence and information to provide if the Manhattan Club continues to pursue legal action.

Kevin, I know this and I am not intimidated in the least. Over the years, other owners have stopped paying fees and shared that once they pointed out to credit bureaus and such that TMC had been found guilty of fraud/bait and switch etc by the NYAG, any further efforts to collect were dropped. My Mother, who bought these timeshares and who died suddenly in 2013, had just begun to realize she had been seriously screwed. I continued to pay the fees and enjoy the place, but with everything that has happened, the continuing rising of fees, and being forced to have to go to NYC at a particular time every year, losing last years fees and very likely not being able to go next year, I have to seriously consider taking the offer. No more fees, being able to use the time and money elsewhere or someplace nicer and cheaper in NYC at a time that suits me to go and being free of this commitment I never chose to take on is very appealing. My Mother payed around $50-60,000 total for 2 timeshares. What is the likelihood, I would get that back if I hang in there? Like I said, these are very personal decisions...each to his own.

With this many owners being disenfranchised why is this not a class action suit. Won't this bring more money to the Zimmerman firm in the long run. Some of us are struggling right now and don't have those extra funds.

It do not think it is class action as not all of the members have the same complaints or documentation regarding their dissatisfaction. Inability to pay is not grounds to be part of a class action suit. I'm not an attorney but this would be my perspective.

i am questioning TMC telling me i cannot cancel a partial reservation. i cancel all or nothing. i believe i own it for the days of my reservation and therefore can stay or leave when i want if i give them due notice. sounds like an illegal policy ..................???? anyone have any thoughts.

I just contacted Lynne O’Donnell about the giveback. She said she would put my name on the give back list but it could take years... I recently received my tax and maintenance fee bill. I paid the taxes but my not the maintenance fees. Any suggestions from those who have been through this process?? Thanks in advance, Donna

Is there any legal obligation/trouble if one STOPS paying both the tax and maintenance fee? One cannot use the TMC anymore, but will "void "the TITLE and forfeit any original investment. The fee is killing me and I am too old to use it. Does the new Zimmerman lawsuit requires the participants in good standing (payup fees)? Any opinion is appreciated.

This is a no win situation. I just got my maintenance fees. $3000 up from $650. For a 4 day stay one year and a three day stay the next. New York City has basically been closed to all the I interesting points and TMC does not care. They are all going to rot in hell, especially our initial salesperson who assured us fees would not increase that much and if we ever became dissatisfied, they would buy it back. If she was standing in front of me right now...... I’d have to hold myself back

Somewhere in your paperwork there is probably several clauses about defaulting on maintenance fees and taxes. The only question is when/whether TMC is going to take foreclosure action against you. Of course they will deny your use of TMC while you are in arrears. Eventually they'll probably foreclose and perhaps selling off or reclaim your 'deed' and incorporate it into their inventory..

I would tend to believe all owners have the same complaints. Yes, it should be class action. I bet all the ownwers don't even know about the Zimmerman lawsuit.

I just received my maintenance/tax bill, too. I also have a split week. My fees have more than doubled. I got the same speech about the buy back “anytime” and fees. I tried to sell years ago, that’s how I found this forum. I wanted to list my timeshare on Redweek but there was page after page of MC timeshares for sale (surprise). There have been others on this site that have successfully given back their timeshare but they probably don’t read the posts anymore.

Lynne O'Donnell is as much of a liar as the rest of them.

The list doesn't exist, she and others are just there to yes you off the phone.

The property is worthless, so stop putting money into it. People who stop paying get the rescission offer while people who still pay are strong along. After all, why would they stop the stream of money?

I believe or understand (Perhaps erroneously) that owners have different types of contracts/situations/complaints. Also, one of the major issues that Zimmerman is working on is getting the list of TMC club owner’s names and addresses which the club will not release. This information was shared on the forum earlier on. Many owners are likely unaware of this forum and/or Zimmerman. If they knew, there is power in numbers and a class action suit would be perhaps viable.

You are absolutely correct. Other owners have stopped paying their maintenance fees and eventually they are able to give it back, I just had to wait until my fees were due. I know there is no magical list. I just want to cut my loses and be done with it.
