Manhattan Club Lawsuit
I just got a call from Nicole at MC about our unpaid taxes and maintenance. I told her we weren’t paying anymore due to the fraud. She asked if that means I don’t want to be an owner anymore which I said yes. She said they would initiate foreclosure procedures on it. So I said ok and that was that.

My wife received a call from the MC office about our 2020 maintenance fees, which we haven’t paid and willI refuse to pay, permanently. When we bought the MC timeshare the salesman promised the MC would buy it back at the original cost whenever we wanted to sell it. Of course, that was a lie. So we were defrauded.
Unfortunately I don’t have a copy of the contract or deed. What should I do? I’m thinking of calling the office to tell them that I misplaced the deed/contract and ask them to send me a copy, which I assume they must have. Does that make sense?
With the deed/contract in hand we can then offer the MC to buy it back for the $100 fee. It’s well worth the $100 to be rid of the Manhattan Club.

I quit paying the fees last year. I ignored all communications from them. Then they sent an email offering the buyout... I signed the papers after having my lawyer look over things and notarizing. Receiving the papers from them took a couple of weeks and a few days on my end. I asked for copy of final papers but made copies of what I had and they said I could expect to wait months to get the $100. I am so relieved to be free of this albatross.

i AM SURPRISED THAT ANYONE CONTINUES TO PAY TO DIRECTLY FUND MC SCAM. i have not paid for 4 years and after a while i told them I would not accept the $100 , and instead sent about $1200 to MY lawyer Jean mark Zimmerman to continue to press on with a class action suit. I am happy with his progress and want you all to know that unless you contribute you may not get anything if we prevail. I have had no credit agencies or harrasement from MC and possibly may get a nice court settlement instead I have little interest in reading the same lame stories from people who refuse to stand up to crooks. WOULD SOMEONE TELL ME WHY YOU WANT OUT AFTER PAYING SO MUCH AND PERHAPS LOOSING EVERTHING FOR $100.?????? i HAVE BEEN ACTIVELY THINKING OF OFFERING OWNERS $101 AND BUYING A FEW OF YOU OUT. SEEMS TO ME BUYING YOUR OWNERSHIP WOULD BE A BETER INVESTMENT THAN ANY LOTTERY,, ANYONE OUT THERE WANT TO JOIN IN MY POKER GAME????

Sidney. How do you know what I have done? I have not refused to stand up to these crooks and have done so for the last several years. I don't owe you an explanation for my choices but I will give you one. I inherited choices my Mother made. I did not buy the two timeshares I was left and at the time did not think my Mother should get involved. I no longer wanted to be beholden to escalating fees and a yearly commitment to show up in New York when I have the desire and possibilities to visit other cities and countries. The money I spent on TMC can now go to new adventures and I can still go to NYC when I want and probably much more cheaply. And I can put my life force and energies into enjoying life instead of participating in a long, drawn out and draining legal situation, again. That is my choice. Sorry you don't understand. I understand and respect the choices others have made. Mine is not a lame story. I was specifically answering Kim’s question. This site is for sharing information, not for the intolerance and denigration of other people’s choices or their desire to unload a horrible situation.

Hi Mary. I’m sorry to say that I don't remember if I was on the list. I have a feeling I was. It wasn't long before I got an email from them offering the give/buyback, after I stopped paying fees. I stopped paying in July of 2020 and they made the offer in late summer of 2020. I ignored all billing, phone calls etc since January 2020. I want to add that my Mother bought her timeshares in around 2000 and over the years lost out using the place on a few occasions due to my younger sister’s serious health issues (which added up to several thousand dollars). My fees were up to $4000 for a penthouse. I inherited years of stress and incurred (thousands of $$’s in lawyers fees in 3 States, bad legal advice, assessments etc). I don’t have a lot of faith in lawyers or the legal system. These experiences further governed my decision to get rid of the place when given the opportunity. There is no way I was going to pay another lawyer more money and wait around for a possible favorable outcome. I wish all owners the very best in whatever they choose to do.

Mary, the reason Manhattan Club (liars) say it doesn't matter if you are current in fees or not to be on the buy-back list is simple. If they told you that they are offering the buy back to only those in arrears, there would be a boatload more owners stop paying their fees immediately. That would be a negative financial situation for them. Almost every answer the M/C people give is toward their own benefit, not to their membership owners (us). It's always been that way. I've been an owner since 1996 and I've seen that forever with them. They are liars, cheats, and thieves for the most part.

I've been on TMC take back program for 3+ yrs with no answers. Does it take ignoring the payment of main. fees to get answers; sure sounds like it. I just don't want to screw up my credit rating. I assume there's a protocol in order to avoid such damage. I've owned there since the mid 90's and I'm so over them and their immoral practices. Any other advice in cutting the cord? Thanks much

The greatest tragedy of the former NYAG Scneiderman Assurance of Discontinuance with The Manhattan Club is there was no requirement that all owners be notified of the fraud investigations and findings. There are thousands of TMC owners particularly overseas who still don't know. This is important because the Statute of limitations starts when the Owner discovers the fraud. Zimmerman getting a copy of the list of owners is vital.

I have been on this site since it's inception and have followed it religiously. A few owners stated they had no issues with credit bureaus when they stopped paying fees. Others said they did but, when they pointed out the law suit and the fact that TMC had been found guilty of fraud/bait and switch, then the credit bureaus let it drop. You can sift through 7 years of posts, but I do remember several of these instances. I am sharing information, not advising anyone to do anything.
